      Update 19-9-2011

      M&S CC
Letter received from Gothia Saying that they have not had a response to their previous letter and threatening all kinds of stuff (warrant of Execution,Home visit & attachment of earnings ) - their letter is dated 14-9-2011 ,so my letter has probably crossed in the post.

Will drop em a quick 1 liner refering them to my letter and tell them that I await their response.

      2:Co-op CC
Letter from Moorcroft advising of POSSIBLE LITIGATION.
They go on to list the debt and court costs that would apply IF judgement is obtained.

They first contacted me in May 11 to which they got the sold in dispute template and did not reply to.

I will drop em a line refering tham to this and asking for their response - or would it be better to just send off the threat of litigation template?

      3:Halifax CC

      2 letters received from Moorcroft:

1 as above for the Coop card - possible litigation etc & the other in response to the 'application form rec' template saying that they dont need to provide a signed copy etc and refer to Carey v HSBC where the judge agreed to this interpretation of the legislation etc and that I must pau up in the next 14 days.

Threat of legal action in response to this?

      Regards,

      Matty

No reclaims involved with any of these Boss - mores the pity.
Maybe just a few illegal charges if they ever start to press me really hard (court)

I will of course check with any that do.

              Thanks for dropping by

                • Re: MattyA UE Diary

Couple of letters received today both re seperate MBNA accounts:

1: From Freddies saying that despite my claims that the debt is incorrect they have contacted their client and that they say that the details are correct.
Not 100% sure what to do wih this one - so will probably ignore for now.
Account is UE(not paid for over a year) and they /various DCA's have had various templates along the way - however I have recentley had a successful PPI claim against them on this.
They have not however refunded illegal charges and associated interest, so the figure claimed IS incorrect.

2:Received letter from AIC (who have been bugging me at work) 'encouraging ' me to ring them
1st time I have heard from this lot on this account so will bang em off a sold in dispute template

                    Halifax

Letter recceived from Moorcroft re my Halifax account in response to above.
They quote section 78 requirements,Carey v HSBC etc, enclose a further copy of my original signed application form (deemed UE by the Boss) and say that as they have complied collection activity will continue.....

Time to send em the 'enough is enough' template me thinks.

                    RBS - Natwest Credit card

Wescot have sent me a 'FINAL NOTICE' in red, saying that they have now confirmed that I am still resident at this address - well done them!
( As I have only ever corresponded with them and their client from this address its hardly rocket science is it?)

This account is deemed UE anf they have all the templates upto and including the enough is enough template which they have ignored.

I have two other accounts in dispute with RBS re PPI claims which are upheld and awaiting figures - these should wipe out the debt on all accounts.

Not to mention illegal charges etc which make up part of this and all other balances - which I have yet to claim back.

I think I should leave this for now......or maybe drop them a line telling about the upheld ppi claims and that if they start procceddings a counter claim will swiftly ensue?

                    HBOS

Letter from Robbersway - 1st one from them on this account so will send em the 'sold in dipute' template

Finally - for now at least....

Letter from AMEX with a settlement offer....knocking 21% of the outstanding balance.

                    Staggerinng - absolutley staggering.

This account is in dispute on 2 counts - Illegal charges and PPI reclaims.
Both up held by FOS but Amex would only pay the 8% stat interest and refused to pay contractual interest....which I wont accept , so it is awaiting review by an ombudsman.
This has been ongoing since last September (2010) and has been upheld since Feb of this year.
The amounts involved will clear the balance several times over and some.

I have had a thought that maybe I should go for F&F as low as I can get rather than them deducting the full amount outstanding out of the monies they are eventually made to pay back....if that makes sense?

Thanks Boss - Much appreciated as ever.

It is Amex who are hassling me / offering the reduced settlement figure.
At first I though it might be a trick (still do a little) in an effort to quash the claims I have against them....but I cant see full & final settlement mentioned anywher.
                        Balance is £1900 ish

I am not sure to be honest - Amex I assume but I have been chased by Newmans and AIC to date.

Amex say that they can stop further collection activity if I settle the account and that they will register the account as settled with CRA's.

Sorry Boss - I was wrong with the HBOS(got accounts mixed up) - they have had 'sold in dispute' and 'application form received' templates - should I bang off the 'enough is enough ' template or just leave for now?
Their letter is quite generic 'furthr action MAY be taken etc etc.
They have basically ignored my last letter to them.

Amex will not really settle mate, as things stand and the relatively low balance - do not make an offer, just store all documents sent as you will use this against them if they try and get clever....

No offer mate, just see it through.....
