    Hi,
    Lewis had me in court within a few weeks (bit slow sending a response to them) but my cca was ENFORCEABLE so I would send that off if I have anymore dealings with them.

      Lewis/Howard Cohen also had me in court pdq even though I replied to that straight away but, like helmsman, my cca was enforceable. And, of course, every case is different.

      If Niddy has said the cca is UE you should be okay. I think you're right to send the 'sold in dispute' letter.

        Thing is Matty *could* settle this long before any ccj was ever granted, so if necessary a F&F can stave off action but in the meantime I would send the sold in dispute and see what happens.
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

        If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

            Morning all - hope everyone is well and fighting the good fight.

            Bit of advice please if I may.

            Natwest CC account deemed UE by Nidster.
            Its been around the DCA's the latest being Moorcroft who have had the 'sold in dispute' template.
            Their response seems to be a 'new tack' from them (I have had a lot of dealings with them on various other accounts) with their response coming from their compliance officer.
            She says that she has noted my concerns and has brought these to her clients attention and will revert back with their response once received - all pretty much standard stuff.

            However ....she then goes on to regurgitate my letter(Sold in dipute template) back at me in relation to OFTs guidance re unenforceability almost word for word and also drops in reference to the ICO's stance on the matter along with reference to OFT's 'recent' press releases warning consumers about unenforceable claims.

            She goes on to ask me to provide details of any specific concerns regarding my liability for this account to ensure all matters are resolved as efficiently as possible - Is that not what the 'sold in dispute' template does ffs ?

            Finally she says my account is on hold and remains under her sole care until they are in a position to return back to me with a response.

            Seems like a load of gobbledy gook to me and I sit tight and await their response.

            Please shout up if not.

                    Recieved a letter yesterday from Howard Cohen Solicitors (dated 20/12/11 ) sayoing that if payment is not made within 7 days their instructions are to continue with further action against me and that I should seek independant legal advice.

                    Seems like they mean business.

                    Should I send 'em the threat of legal action template or is it time to try and negotiate F&F?

                    Anybody had dealings with this lot and if so how did you get on?

                      Not much you can do before Xmas but yes send this > Threat by Creditor - Threat-o-Gram Letter Before Action

                        Do you have access to a fax machine? Most corner shops have them. I2D says send Threat-o-Gram Letter which must go by Recorded Delivery when the post office next opens. But you can also send a copy by fax to both today as back-up and get a proof of faxing (transmission report) from the shop too because of the Christmas postal delays. You may have a fax of your own or pop into an office and ask a favour (my local Rymans has a fax service). Here are the fax numbers:

                        Lewis Debt Recovery 0870 751 3123 and 01274 347 300

                        Howard Cohen solicitors 01274 853 970

                        Have a great Christmas

                            FYI - Both of Cohens fax no's (the one you list + an 0870 number on their website ) get redirected to lewis's 0870 no you list above....strange.I guess they must be linked in someway.

                              I've had dealings with them - which resulted in a ccj BUT it was for an enforceable debt.

                                Send legal threat for now mate. If they try court then make offer to settle (10%)!
