          Update : 15-10-2010

          A few letters received that I could do with some pointers on please as to the best way to deal with (ignore?)

          1: Moorcroft have sent me 2 letters ( 1 for coop account UE & 1 for Halifax account UE) offering me option to pay £120 per month on each account........lol. Thats very generous of them ....but erm......NO THANKS.

          I assume I just ignore these.

          2: Letter from robbers way re BOS acoount (U/E) sying that they are satisfied that the documentation provided is sufficient to demonstrate liability and that they will not ener into repetative correspondence regarding this blah blah ....and that they require my payment proposals inthe next 14 days.

          'enough is enough ' template?

          3: Wescot re RBS - UE.
          Saying that I have requested a copy of the signed agreement - but informing me that I must contact RBS directly for this .....?
          WTF - I have already done this a year ago....I dont think they can read as the template(s) say that my request hasnt been complied with as I have not received a compliant agreement to date.

          They dont threaten anything or give me any deadlines so I will treat this with the contempt they have treated me and ignore.

          4: Freddies re MBNA U/E.
          Very similar letter as above from Wescot.
          I will treat it in the same manner.


          Hope Im on the right track - if not someeone please shout up.

              Update 1/11/11

              Hi everybody - just returned from 2 weeks holiday (Hope you had a good one your Nidship) and to a pile of letters - 14 in total (1 a day is not so bad I suppose)

              1:Yet another letter from Robbersway thanking me for me 'recent contact' and again confirming that their client has rejected my dispute.
              They also now inform me that I can go to the FOS if I want to.
              They say they will hold my account for 14 days to enable me to provide them with an FOS number....after that normal collections will resume.
              I thought FOS doesnt do UE....is this some kind of ploy to trip me up?
              I will ignore for now as I am not sure what else to send this lot now.

              2: Letter from Cabot re my Opus account -confirming that their client has failed to comply with my CCA request as the documentation provided is incomplete - so they have 'ceased collection activity' on my account but will continue to report to CRA's accordingly.

              3: Another letter received from Amex reminding me of their settlement offer - which I will file with the last one and await the FOS's findings.
              *Also received a letter from the FOS apologising for the delay in resolving my complaint - I think I will be waiting a while longer yet.

              4: Letter received from Moorcroft re my Halifax account informing me that they have returned the file to their client - lets see who picks this up next.

              * Letter recieved from Wescot chasing this - will send 'em the sold in dispute template and start the ball rolling all over again.
              (These F***ers have also been ringing me at work while I have been away.)

              5:Letter received from Moorcroft re my Co-op account - now offering a 30% discount off the balance (£13K) - should I counter this with a 10-20% offer or continue down the UE path?
              A number of DCA's have had this in the past and Moorcroft are the latest to have a crack at it.

              6: Letter received from Credit Security Ltd re my TSB account.
              Not heard of this lot before and this account has been quiet for a while.
              Will send off a 'sold in dispute' template.

                  The alternative is the possibility that one of my other creditors will come back and accept my offer made to them, thus reducing the amount available here, also delaying things into a several year £1 per month payment plan - this can be avoided by simple acceptance of my payment of £1000 for full settlement and closure of this account.

                  To summarise, I am more than happy to settle for a single one-off payment of £1000 to be made within 7 days of receiving your response, so long as this response agrees with and ensures that the following actions will be carried out;
                  1. You accept £1000 in full & final settlement of this account with no reference or future ability to quote or use Penny v Cole [Pinnel 1602] in trying to recoup any written off balance;
                  2. The Status of the account will change from “Defaulted” to “Settled”;
                  3. The Current Balance will appear as £0.00;
                  4. The Default / Delinquent Balance will be set to £0.00;
                  5. You will update the entries on all 3 Credit Reference Agencies, namely Experian, Equifax & Call Credit
                  If you're happy with my proposal, please respond confirming each of the above points on official letter headed paper, confirming that you're happy for a single payment of £1000; and I'll then send a cheque in the next day so we can close this and move on.

                  Finally, please would you be so kind as to provide a copy of your paperwork, by return, that confirms your firm employs and utilises Judges and also confirm what jurisdiction you're basing your wild assessment that this

                  Letter received from Received from Resolution Legal services threatening legal action if I fail to agree substantial payments re my M&S account.
                  They state that this is because I have failed to resolve the matter with Red Castle Recoveries - never got a reply to the letter above from Red Castle , so it seems as though they have just passed this straight on.
                  (I note that both Redcastle and Resolution are part of Gothia)
                  They also set me a deadline of the 31/10/11 to comply - which I have missed as I have been out of the country until today.

                  Not sure what the right tack here is - write them the same letter and maybe up the amount offered a little to try and resolve?

                  This account is enforceable.

                  All help and advice ,as ever, is greatly appreciated.
