I suspect a little drinky is in order - great news Matty!Originally posted by Never-In-Doubt View PostMorning matey
Well done - this is now finished! They have confirmed it is UE by way of that letter, it is NOT enforceable - although yea, they can (and will) hassle you - but so what! Basically, if anyone writes about this debt again, you photocopy that letter (so keep it safe - very safe!) and send it with one of these: ---> CCA Query - Letter Previously Confirming No CCA

No court papers yet which surprises me as it has been going on since last July - they must be really p****ed off with me by now,as the account is enforceable.
I will keep on stalling and send off the letter above......its just knowing when the right time has come to throw the towel in and try to agree a payment plan.

PS Hope you and your family have a great holiday - you deserve it !
Thanks again,

I'm in a similar situation with an enforceable M&S card, was paying £60/month (owe about £2800) and can't afford to increase it at the moment, however the DCA are demanding an increase. I don't know how long they will keep accepting moderate payments for, before they just go for the jugular.
I comfort myself it's not MBNA, they seem very Court-happy
Will be watching your thread. Fingers crossed!Niddified and proud!

Funny you should mention MBNA - I have 3 accounts with them( all deemed UE) and they have been very quite up until yesterday.
I received a letter from Debt Clear Recoveries & Investigations Ltd demanding that I settle the outstanding amount on 1 of the accounts.( smallest balance).
They are going to get the 'sold whilst in dispute' letter & so the process starts all over again.
Has anyone heard of this lot ? - I have not heard from them before.

Re: MattyA UE Diary
Hi There Matty,
This is my first post and just thought i would wish you well after going through your mammoth thread lol. I looked in mostly as i have an mbna card in dispute too and it is an ex- A&L one just like yours. They say they cant currently comply with my cca request either. I will post up my own diary this week, it seems a really friendly place.
GOOD LUCK :-)

Just send off the sold in dispute template and see what happens...... yes, they are a normal circuit DCA - they're not new by a long shot, and act as bad as the others as well......Originally posted by MattyA View PostThey are going to get the 'sold whilst in dispute' letter & so the process starts all over again.

Click this for a funny read of how they tried to take action for an £800 debt!

Thanks Jetset & good luck in your quest!
It will be a long and winding road with plenty of ups and downs - but one thing for sure is that you will get all the help and support you need to get you through.
It wont be easy, but stick with it,believe and you will get there eventually.
Matty
PS Them not being able to comply with your CCA request is a good start.

Re: MattyA UE Diary
Morning all.
Had another letter from Tri-it-on.They seem to ignore everything put before them.
Have others had similar experiences?
I have sent them the 'sold in dispute' and 'threat of legal action' templates and their latest response is that they have recomended that their client commences legal proceedings.
I am now going to send off the 'enough is enough ' template and see what that brings.
(FYI - account deemed UE by his Nidship and all they have sent,to date,is copies of terms and conditions allegedly from the time the account was opened - late 90's.)
