      I agree. Send this ASAP. You might be best doing what I've suggested Clueless does too (send a backdated cca)

        Will get CCA off today - 1 question though if I may?
        If I am back dating it had I better not send it recorded delivery then.....ie proof of date it was posted?
        Or am I over thinking it here?

                I always keep a one pound postal order in my file ready for when needed in emergency (e.g. to send a CCA request sharpish). They have a six month shelf-life.

                When backdating perhaps a handwritten cheque would be a better option.

                I also think a Royal Mail 'Signed For' Track and Trace receipt is invaluable in the event of unscrupulous solicitors/creditors denying they got the request in court.

                  Quick update re MBNA M

                  Sent both letters off as above, CCA first and then LBA last Thursday by SD.

                  Whilst waiting to hear from them , I just wonder if it is worth a re-visit of the agreement to see if still unenforceable....hopefully nothing has changed since 1st checked late 2010 (account goes back to the 80's)
                  They do seem quite confident theyve got me due to my signature being present , along with my address on the 'acceptance' slip that they have produced again.
                  Is this a PAYGO service now?

                  As this is my smallest amount outstanding (£3K) , I could be tempted to try and F&F it , rather than go down the court route and throw more money at it.

                  My only worry is that this path could open up a can of worms with 2 other accounts that have been quiet for some time.

                  Probably overthinking it as ever.......

                          Further to my CCA request Drydens have written back advising me that I need to pay a fee of £1 ......der
                          Have written back to them advising that, as stated in my letter I included a PO for £1 which was stapled to the letter.
                          I also attached a copy of the receipt for said PO from the post office.
                          Games , games , games.

                            Quick update : MBNA M above
                            Letter received telling me collection activity on temporary hold whilst they contact their client for further info I assume.

                            MBNA V
                            Same story as above, defaulted in 2010 , balance circa £6k - not paid since then , been round the dca's.
                            Arrow have now passed this account on to Drydens.....here we go again.
                            I think they think they have me.....we will see.

                              Quick update on my MBNA M fight

                              Arrow have responded to my CCA request for the MBNA M account and have forwarded copies of the same information as previously supplied by numerous DCA's in the past , namely:

                              A statement of account , a copy of the agreement (signed acceptance form / slip dated 12/11/1997) and copies of generic terms and conditions - I assume they claim were sent with the acceptance form , which they weren't.

                              They say they have complied with my request and that all correspondence should go to Drydensfairfax who are operating the account.

                              I guess I wait for Drydens to contact me again and when they do send them a letter advising that they have failed to provide the information requested in the CCA as they have provided an acceptance slip and not a copy of the agreement etc.

                              In the mean time would it be worth someone re checking if what they have sent is enforceable or not....?

                              Has anyone else on here had experience of the MBNA 'acceptance forms' ?

                                Hi Matty, I'm in a similar position with Arrow regarding a MBNA account, although in my case they have assigned the account to Clarity, I received a copy of the original application/acceptance form and a set of genaric T&C from Arrow, obviously not original T&C's as they show my current address and not my address at the time I opened the account which is showing on the "Acceptance" form.
                                Not had any demands yet from Clarity but no doubt I will do soon.

                                The paperwork has been previously deemed UE, but I may let niddy cast his eye's over them again just in case anything as changed that may alter my UE strategy.
