      THis is not applicable to a credit card agreement as a credit card is a variable form of credit and therefore, the document is unable to stipulate the total charge for credit unlike a loan which would have a fixed term loan and amount,'
      They go on to say:
      'Turning our attention to section61-(1)(a) whereby the act advised on the form itself should be signed by both the debtor and the creditor, whilst a signature of the creditor is not present on the agreement provided to you;this may be a copy of the document when it was first signed by you and scanned to our clients systems. The lenders signature may have been added at any time prior to the facility being granted. Furthermore , the agreement was signed by yourself, agreeing to terms and conditions also supplied to you.The card facility was issued to you and used by you. Given this , I cannot agree with your comments and can only conclude you have acknowledged the debt'


      All they have provided thus far , is a copy of the acceptance slip , which does refer to t's & c's and a couple of statements , No T's &C's or application form with T's & C's on it.


      THis card goes back to the late 80's and if my memory serves me right , I didn't have to apply for it , they sent it to me as I already had another card with them.


      Any ideas / have they got me with the signed acceptance slip?


      Final wriggle would be PPI, I have had 2 claims with them on other accounts (not this one) both of which have been settled but under the proviso that they calculated the redress properly and in accordance with the FOS guidelines - Recent writings in the press seem to conclude otherwise.


      Or do I just hit em with the enough is enough template ?

      PS - They go on to say that if I am not happy with their response , I should refer it to the ombudsman or speak to my local CAB etc etc.

      Hi all - quick update on this one.
      Recieved another letter from Rockwell saying that They have been trying to contact me blah blah re repayment of outstanding debt.
      I sent them a quick ditty referring them to my previous correspondence confirming etc about the account being in dispute.
      They have written back referring me to their previous correspondence and that they have answered my queries and asked for my proposals to repay them , thoughtfully including an Income and expense form for me to fill in........don't think so!
      No threats etc......tempted to ignore this one now as it's just going around in circles.

      Will keep you posted.

            latest update:
            Sent em the 'enough is enough' template.
            They have written back referring me to their last couple of letters saying they have answered my queries and now await my payment proposals .
            No threats as such.
            I will send em a quick ditty referring em to my last letter and leave it at that for now.

                  Letters (2no) received today from Fenton cooper -informing me that Rockwell have based my account on to them , that Rockwell have previously answered all my queries , that they will not be entering into any further correspondence on the matter and ohh by the way pay up!
                  new tack for me this one.....
                  Has anyone else had experience of this mob?

                      Tessera is Rockwell is Fenton Cooper.

                      Wonder if after all the FCA interest in the consumer not having a clue who they are speaking to,if your letter is explicitly advising you they have passed it in house?

                      Pretending to be a solicitor and pretending to be another company. Both seem pretty scummy tricks.

                          MBNA M Card
                          Wrote back to Fentons asking them who they were etc and referring them to previous correspondence.
                          They have written back , with a copy of the same old stuff ,copy of a signed acceptance form ect, (all as seen before by Niddy ) that MBNA and all other DCA's have sent previously.
                          They don't really threaten me as such , but say that it is their final response and that if I am not happy with it I should contact either CAB or FOS.

                          Not really sure what to do with this now , as we they have had the' enough is enough' letter ? - might just file , sit tight and wait and see....

                            That's what I'd do .....if it were me .......seen these letters before hopefully you wont hear anything

                                MBNA M Card update

                                Didnt have to wait long.....they must be smelling blood!
                                Arrow have now written advising that my account has been passed on to Drydensfairfax solicitors.
                                A bit worrying to be honest , last time a solicitor got passed my account ,proceedings followed pdq.
                                Anyone had any dealings with this lot?
