    16-05-12 Letter received from MKRR - As you have not taken up our offer to help,your account is now with our pre-legal dept.
    This has left us with no option but to transfer your account to *Raven Recoveries to resolve this on our behalf. This may involve applying to the courts for a County Court Judgment which will enable us to commence with one or more of the following steps.
    * Instruct a bailiff to remove goods from your property.
    * Obtain a charge against your property.
    * Deduct monies directly from your salary through your employer
    (erm, I am my employer )
    * Obtain monies directly from your bank account
    ( What!, not had this threat before )
    * Request you attend court for an examination of your financial means.


    *Not had any previous dealings with Raven Recoveries, so will wait to hear from them before deciding on my next move.

    Strange you mention you suspect MKDP and barclaycard are connected,I had the same gut feeling both their letter and the Barclycard letter both look exactly the same in format and the envelopes bear the same Milton Keynes return address on the back.

    This account was taken over by Barclaycard a few years back from the OC - Morgan Stanley, To date I have never seen any CCA from Morgan Stanley or Barclaycard, so I'm quietly confident one won't be appearing any time soon.

            Barclaycard uses the below for recovery for Loans, Debts etc -
            MKDP operates from same address as MKRR - Milton Keynes Rapid Recovery (Which don't have a website) looking further MKDP operates under umbrella The Compello Group at the same address ( Outsourced Debt Servicing | Debt Purchasing | Commercial Collections | Compello Group ) -

              Account passed around a couple of DCA's, but now owned by Cabot


              9th December 2011- Another letter received from Cabot insisting the Capitol One credit application form and T&C are fully compliant and the account is enforcable, so this matter cannot continue to go on, I must contact one of their helpful customer advisers to discuss the options for repayment of this debt !
              3rd April 2012 - Letter from Cabot,insisting once again that they have fully complied with my s77/78 request by providing the correct documentation.
              I responded and advised them that an application form that does not encompass all the T&C is not a compliant CCA, so I still consider the account in dispute.

              16th April 2012 Letter from Cabot stating "Last chance to agree a suitable repayment plan before we move your account to our Pre Litigation Dept"
              2 May 2012 Letter from Cabot - " You account has now been escalated to our Pre Litigation Dept. If we don't hear from you, we will make a decision on what the next stage of recovery to pursue, this could be County Court Judgment, Charging order on your property, attachment of earnings order, Order to Obtain Information - you may have to attend court to be questioned under oath by a court officer..
              Alternatively we may instruct an External Debt Collection Agency or Legal Agency to call on you"


              Judging by the rapid response by Cabot in replying to my letters, it looks like they are digging their heels in on this one and moving fast through each stage, so not sure what my next move will be yet....
              Having not heard anything since last May,
              Cabot have raised their heads again Re the above Capitol One account, I have already made it clear to them that I have only ever received a credit application form and updated set of T&C and never received a properly executed CCA from Capitol One and therefore the account is in dispute.

              Will back write and remind them again to refer back to previous correspondence.

                  They specialise in issuing Statutory Demands and then making people bankrupt. With an alleged debt of that size, the threat needs to be taken seriously. Make sure you are aware of the procedure for setting demands aside, because you only have 18 days to do so.

                  It may never happen, but I would certainly want to be prepared in case it did.

                    Now Owned by Arrow Global Guernsey


                    Having been passed around a few DCA's since 2010 before being sold to Arrow Global, this account as now been passed to Rockwell for collection activity.
                    I never received anything other than a basic account application form from MBNA in answer to my CCA request.

                    Will write back to Rockwell and inform them the status of the account remains in dispute until such time I see sight of a compliant CCA.

                      i would say if the account is sold is in dispute with the OC, then basically they can do diddly squit unless they can pull out a CCA Agreement, in which case why didn't they produce it then?

                      i've telt them to pi** up someone else's tree (lowell- bed wetters, no balls to hold in there pants)

                          I recently had a co-op non-debt from the co-op sold to lowells too and my letter no doubt came at the same time as you.

                            Well after not hearing from Cabot for a year on this one, they have now wrote to advise me that they are now passing my account to their debt collection agency (Financial Investigations & Recoveries Europe Ltd) Whooa...thats a fancy long title ! I thought Cabot did their own dirty work.

                            Having never received anything from Citi cards or Cabot except a standard copy of Terms & Conditions, I will write back and refer them to my last letter pointing this out, and as such my position remains unchanged while Citi/Opus are in default of my CCA request.

                            Looks like my name has come to the top of the pile again with Cabot, this is the 2nd Letter from them in a week after having no communication from them for months ,the other being my Capitol One card account which they now own.maybe they will be going for the hat trick this week as they also own my Monument card account which I have had no word about for a year.

                              This is just par for the course with Crapbot. For three years, they did nothing with my case except send the same two silly templates in rotation, both of which were always ignored. Then, when it was within a year of SB, and when Neil “Asinine” Clyne took over as chairman, it started to go on the scenic tour of equitable assignees.

                              First up are always FIRE (Facetious Irrelevant Rubbish Emitted), and then when they get nowhere it gets farmed outside. I don't remember this ever happening when Uncle Ken (Maynard) was chairman.

                              I think it is a good sign. Crapbot are using less litigation than previously, and have started to use outside agencies to do the harassing which they used to do themselves. It is always better to have these things in the hands of those who can't take action, even though they can quickly refer it back to those who can. There is certainly no immediate danger.

                                Received a letter back from Lowells Portfolio, acknowledging my letter to them regarding account sold while in dispute of CCA request.
                                They advise they are going back to the Co-operative Bank for further information, and will contact me again as soon as they have heard more from the Co-op.

                                At least Lowell's haven't come straight back at me with a SD notice for now. So will just have to sit tight and see where we go from here with this one.
