      September 8th letter received from Albion Collections, the lender has told us they are taking further action to recover the amount owed, this could include legal action, and a debt collector may visit my home to collect the debt!

      Well somewhat disappointed by receiving a couple of letters regarding the above account, not heard anything for a over 3 years since Halifax informed me they would not enforce this alleged debt unless they could supply me with my CCA. Now Lloyds Banking Group who took over the Halifax business have sold the debt to Capquest, who have managed to a get a copy of my CCA from Bank One (the original issuer of the card before it became a Halifax card.) So I have now got a CCA and a letter of Pre Litigation Action if I do not pay up or arrange a payment plan !

      I think this needs some quick action before it develops into a bad situation..I will let Niddy look over the CCA before I respond to Capquest...

        Interesting Allan, I've got a similar situation developing. Someone at Halifax seems to be making it their life's work to find previously "lost" agreements. I'll be doing a thread on mine shortly.
        You can be one of the first to test pilot the new agreement uploading facility

          Bank One are also providing ENFORCEABLE agreements. Although HBOS said they'd not enforce; it seems that now they're finding the originals and so far they are good.

          Buggery. I'll find a fault - but for now Allan needs to issue missing PT's to buy us time.

            Yep Elsa tried the new uploader and it works a treat.....sadly this CCA on first inspection by the boss it appears..

            But hey you don't be worrying about your Halifax one,..all our situations are different, and besides maybe they think they have won the battle on this one of mine ...but they sure as hell have not won the war yet.....

                        The one of mine that LLoyds sold to Marlin was initially a Texaco card. Although they sent me a reconstituted Texaco agreement together wit T & C they did not provide the date that this card was taken out! UE.

                          I have a copy of my original Bank1One credit agreement if that's any help. It's from 1999.

                          It's an application form which says the Ts & Cs were "set out overleaf".

                          It asked the applicant to tick which card you wanted Visa or Master-Card. I ticked Visa but Halifax were chasing me for a Master-Card product. From memory they changed everyone from Visa to MC at some point.

                          They sold it to Lowells who closed the account when Halifax admitted they couldn't find the CCA.

                            That'd be ace if you wouldn't mind sending me a copy please.

                            A change from Visa to MC isn't a material change such as your past victory unfortunately but the terms are key for this purpose that I need comparison

                                I wasn't thinking about the storecard upgrade malarkey, I was thinking that since Visa and M/C are different products any recon T & Cs should be clear on which product they're referring to
