    Letter from Wescot once again stating that RBS have fully complied with my S78 request, and therefore there is no dispute, so I must contact them to arrange a suitable repayment plan.
    This was followed up on the 14th December by a letter from Nelson Guest & Partners (Wescots pet solicitors)
    advising me to contact Wescot to discuss a repayment plan as there is “still time” to act to avoid further action taking place.
    Send this (wait till tomorrow for link to work) to Nelson Guest and also a copy to Wescot ---> Threat by Creditor - To Commence Litigation

        Passed around a couple of DCA's, been sitting with Credit Security since October 2011.

        29th November 2011 -
        Letter received from Credit Security Ltd. Asking me to send a payment of £1.00 and they will endeavor to provide me with a copy of my CCA to resolve the dispute.

        I sent HSBC the £1.00 fee with my original CCA request which was cashed by them. All I have ever received from HSBC in response to my CCA request is a blank application form with someone elses name & address hand written on in biro ! and a copy of their current statement showing that persons balance, credit limit card number ect. – very unprofessional of someone at HSBC , I now have it stored safely in case I need it at some stage in the future, may not help my debt issue, but I'm sure it will get HSBC a rap on the legs from the Financial Services Authority.

            You could write to these clowns and attach a copy of the proof of payment and cashment, or just ignore them. Upto you mate....

              Still owned by OC, but passed around various DCA's, latest being Equidebt, who have been writing to me under different guises since July 2011.

              8th December 2011 -
              Letter from Credit Ancillary Services (Part of Equidebt)
              "We have been instructed by Equidebt (but you are Equidebt !)

              to collect upon this outstanding debt, we would encourage you to contact us immediately to set up a repayment plan, Continued non – payment of this account may adversely affect your credit rating (no shit !)


              This letter was followed up on the 20 December by another one –

              Settlement Offer” Our client has authorised a one-off settlement discount on your account of - “An agreed Amount” ? (does not say what that amount is)
              Call us now, this offer is open for 7 days and can be paid over a period of 6 months.

              If you cannot pay immediately, we may be able to offer you a different arrangement over a longer period. Note ALL offers will be considered.

                        Passed around a few different DCA's before being sold to Cabot in May 2011 various standard demands for payment from them since they bought the account.

                        14th December 2011 - Another Letter from Cabot still insisting the documents previously supplied fully meet the requirements of my s78 request, but in addtion they have requested a copy of my signed CCA
                        from Opus, and will forward it to me upon reciept. (I wish them luck in receiving it, because all I have ever received from Citi and Opus is a copy of a standard set of T&C.)

                        Had another letter last week from Cabots insisting I get in touch to prevent legal action, I replied with the "Threat of Legal Action" template.

                        Now received another letter from them - "Final chance- get in touch to arrange re-payment options, or account will be sent to our "Pre-Litigation" dept."

                        Well Cabot have had just about every template now, and ignored everything I have sent them, so I suppose i will just have to wait and see how this progresses, may be soon time to engage the services of Paul and his legal team to fight my corner on this one.

                          Wescot getting restless on this account

                          Letter received dated 28th December 2011 - "Door Step Collection Notice" I replied pointed out again that RBS was still in default regarding my CCA request.

                          9th January Letter received stating collection activity on hold pending investigation and consultation with RBS.

                          10th January Letter received - "Having contacted our client, they confirm all the correct documentation has been sent to you. We believe the dispute is now resolved. They have requested collection activity be resumed. Please contact us to arrange payment of account."

                            19th December -Letter from Moorcroft, stating that in reply to my recent correspondence regarding my dispute, RBS have advised them that they have fully complied with my S78 request and do not consider the to be any dispute regarding the account. Moorcroft have kindly put the account on hold for 14 days to give me time to contact their call centre to discuss repayment options. Failure to make contact within the specified time will cause collection activity to recommence ! -


                            Letter dated 5th January - "Monthly instalment Offer" As we have not received any communication from you with regard to your outstanding account (What ! don't they read ALL the letter I have sent)
                            We feel that you may not be in a position to meet our requests to clear the account in full. In order to stop our recommending to our clients that solicitors commence legal proceedings, we are prepared to accept payments of £120.00 pr month. Failure to respond will leave us with no option but to recommend to our clients that they consider taking legal action against you. This may affect your credit rating !"... bit late for that my little

                              Our team is waiting to discuss this outstanding balance and how it can be reduced. We want to help you. Until you contact us we are unable to offer any assistance and may need to take further action to resolve this.

                                28th January- Another letter received from Moorcroft once they say, having contacted their client, they insist RBS have fully complied with my CCA request under section 78. So they do not consider the account to be in dispute and will recommence recovery action if they do not receive an offer of payment within 14 days.
