Hey don't apologise Paul, I understand you have many more folk with more pressing issues to deal with, than responding to my minor (at present) DCA issues.

Did not hear anymore from MHA Collections, but the account was eventually passed to Wescot earlier this year, I responded with "Account sold whilst in dispute" letter.
Have now received a response from Wescot dated 15/03/11

            Dear alland,
We refer to your recent communication. Having contacted our client they have advised that your complaint has been resolved and we are to resume collection activity.
In the circumstances, we believe the dispute has now been resolved and the full balance or an agreed monthly instalment is required by return.
If in the event you believe you still have a valid dispute, please contact us with the details withon 14 days, otherwise your account will be returned to our recovery team for collection.

            Update
-Sent Wescot a letter -account in dispute pending CCA s78 request, and they promptly closed the account and sent it back to LTSB.

            Update
            - One brief letter from Allied credit, with usual threats of what would happen if i didn't pay them, again like with Wescot, once they received "accouint in dispute letter, they closed the account and handed it back to LTSB.
Since the above updates I have not heard from anyone for a few months on this one until today.

Letter received from Apex Credit Management Ltd. Now acting for LTSB.

Quote" Dear Mr Alland, We believe you are simply avoiding paying your debt(cheeky beggars) and we must act the best interest of our clients.
Note we utilise external data sources to profile our accounts carefully and believe that you have the ability to make payments on this debt.
Consequently your account will be passed to our litigation team in order to consider the best course of action for recovery of the outstanding debt.
This may include legal action to obtain a County Court Judgment which we may then seek by way of a charging order or attachment of earnings application.
Please contact us immediately in order to prevent action on this account/ You can take control of your finances by taking positive action."
            Unquote

That letter reads like a proper attempt to scare me into submission.... Don't think so though,at least not yet..

                Defaulted August 2010
Account passed around a couple of DCA's, but now owned by Cabot

9th December - Another letter received from Cabot insisting the Capitol One credit application form and T&C are fully compliant and the account is enforcable, so this matter cannot continue to go on, I must contact one of their helpful customer advisers to discuss the options for repayment of this debt !

                  Opus card (Formally Citi Financial)
                  Balance £16,658
                  Last paid Feb 2010
                  Defaulted August 2010
Passed around a few different DCA's before being sold to Cabot in May 2011 various standard demands for payment from them since they bought the account.

14th December 2011 - Another Letter from Cabot still insisting the documents previously supplied fully meet the requirements of my s78 request, but in addtion they have requested a copy of my signed CCA
from Opus, and will forward it to me upon reciept. (I wish them luck in receiving it, because all I have ever received from Citi and Opus is a copy of a standard set of T&C.)

                    Update 02-01-12

Marbles Bank of Scotland Card (UE)
                    Balance £2,842
                    Last paid May 2010
                    Defaulted September 2010
Passed around a few DCA's before being sold to Cabot July 2011

Bit of a result on this account

22 December 2011 - Letter from Cabot to notify me they have closed my account and passed it back to BOS, Cabot must have bought it on a "Sale or Return" basis and decided to return it for a refund !
I have never received any CCA from Marbles (BOS) since making my CCA request in May 2010, and do in fact have a letter from BOS saying they cannot supply my CCA therefore no legal action would be taken.

The letter was going to be my ace card if Cabot got heavy, now it looks like I don't need to play it just yet, will just wait and see who takes the account on next.

Letter from Wescot once again stating that RBS have fully complied with my S78 request, and therefore there is no dispute, so I must contact them to arrange a suitable repayment plan.

advising me to contact Wescot to discuss a repayment plan as there is “still time” to act to avoid further action taking place.
