    Letter back from Capquest stating the Judges ruling on Carey v HSBC, and that they can supply a reconstituted application form / agreement that has been reproduced honestly and accurately from other sources.

    And as they have done so and therefore consider that they have now fully complied with Section 78 of the Consumer Credit Act 1974.

    Will need to have a ponder on my next move with this one before it moves on too quickly....

      Just because they may have complied with section 78 that doesn't mean the agreement complies with section 61

          Letter received dated 2nd August 2012 from MKDP LLP to notify me that they have bought the interest in the Barclycard account including the outstanding balance, which is now due under this account.
          This was followed up on the by a letter from Barlcycard also dated 2nd August confirming that MKDP LLP are now the sole owners of the account, and all monies due on the account must be paid directly to MKDP.


          I have never had a CCA from Barclycard in respect of this account, and it has gone back & forth with a number of DCA's since my CCA request in 2010.

          So now I will begin the usual correspondence paper trial with the new owners. Starting with the "Account sold while in dispute" template letter.
          So long since I've had any letters I had to dig my diary up from way down on page 31 !

          So after not hearing from MKDP for a very long time I've just received a "Notice of Assignment" informing me that they have passed all rights title and interest for this account to Hoist Portfolio Holdings 2 Ltd.
          Never previously had any dealings with this company so not sure how agressive they will be, the letter goes on to say the account will be handled by Robinson Way.

          I'll wait to hear what their demands are in due course before responding to this latest letter.

            You are not alone mate - they seem to be flogging all the UE accounts to Hoist

                It didn't take Robinson Way to get in touch, I received a letter from them to introduce themselves and tell me I Must enter into a repayment plan with them. They suggest paying off the outstanding amount at £17 per month for 5 years ...

                The letter goes on to say they have 300,000 clients paying off their debts this way, some pay more some pay less depending on their financial circumstances, but the important thing is they are paying and I should do the same and then I will not get anymore demands for payment or collectors coming to my door !

                Well im certainly not being their 300,001 obedient client so we'll see what they throw at me next.....

                      I'll tell you who they think they are ...they think they can bully people into submission by threats and demands , they assume because we've fallen into debt we are in some way weak and our spirit is broken.

                      And if their claim to have 300,000 people paying them every month is correct then we need to get the word out to more people about AAD

                          After not hearing anything about this account for over 2 years I've now received a polite letter from Cabot informing me that they want to help me clear this debt as soon as possible !
                          No real threat yet, just asking me to get in touch and discuss the best way forward.

                          I will need to watch this carefully as it's fast approuching SB status in the coming weeks, It may just be a co-incidence its suddenly raised it's head at this time or it's possible that they realise time is not on their side and will push forward with a claim if I don't play ball ....

                              Account being handled by Robinson Way.had a couple of letters previously in response to my SWID letter just to say they were awaiting instructions from their client Hoist Portfolio.

                              Now received a letter from Robinson Way saying Hoist have been advised by Barclaycard that they sent their final response and have complied with my original CCA request and therefore no dispute exists and I need to contact them to arrange payment.

                              This account is also due to become SB status in a few weeks, but as Robinson Way quickly pass accounts on to "trigger happy" Howard Cohen I will need to watch this one very carefully.

                              My biggest concern is I'll be leaving for work overseas in 3 weeks and will be out of the UK for 5 or 6 weeks...I would dread a claim coming through while I'm absent and miss the date to submit a defence !

                                Robinson Way sent me an email at 4am this morning regarding the fact that I have not contacted them re: my Barclaycard.
