    Passed around a few different DCA's before being sold to Cabot in May 2011 various standard demands for payment from them since they bought the account.

    After hearing nothing from Cabot on this account since middle of last year, I’ve now received a letter from them advising me that Opus have no record of me disputing this account, and asking me to supply evidence to support my claim that the account is in dispute with them.

    When I originally started my UE claim in 2010 the account was Citi Cards (really old account this was formally Peoples Bank dating back to 1999 !), Citi did send me a CCA copy and separate T& C which at the time was deemed UE, almost immediately after that time Citi sold all their UK business to Opus (CC Asset Management ltd.), I never actually heard anything from Opus, and they unloaded my account onto Cabot soon after taking it over from Citi Cards.

    Once I had a demand for payment from Cabot I replied that the account was in dispute with Citi in respect of my CCA request, they said they would investigate my claim and get back to me, months later Cabot sent me the same CCA & T&C copies that Citi originally sent me and advised me they had fully complied with the 77s-79 CCA 1974 Act.
    I responded with the missing prescribed terms template and I’ve no word from them until now.

    As it is one of the bigger accounts that I’m fighting I want to make sure I respond correctly to their letter, not yet sure with what though to be honest. !

      08-04-14 Letter from Cabot telling me they have once again complied with my CCA request, Quote” We will no longer correspond to letters of this nature, as the matter has been addressed therefore the dispute has been resolved and we are returning your account to our “Customer Operations Dept.” Unquote

      Not sure how I will respond to this right now, maybe a “final response” template letter? Cabot have had this account now since May 2011 and I’ve been playing letter “ping pong” with them ever since, so it looks like they are not going to go away easily…

        08-04-14 Letter from Marlin along with copies of all my previous statements relating to the card, and inform me that they are still awaiting a copy of my CCA. So I won’t respond to this and see what they come up with next.

        *Interestingly I also received a letter from Capquest also informing me they have bought my Lloyds TSB account, I was initially confused by this as Marlin only recently bought it off Lloyds TSB Banking, and it also shows a different card account no. and outstanding amount, on looking back at my files the account number and outstanding amount relates to my Halifax Visa card account not my Lloyds Visa, so it looks like they have their wires crossed on this one, anyway I have sent off a new CCA request so I’ll see what they come up with (incidentally I have a previous letter from a couple of years back from Halifax stating they could not supply my CCA and therefore would not attempt to enforce the alleged debt via the courts, I think I’ll keep this under my hat for a while and see what Capquest’s next move is)

          08-04-14 Letter received from Clarity, I previously advised them that the account was in dispute regarding my CCA request, they have now sent me a copy of my application form and a separate set of generic Terms & Conditions, I think I will respond with “CCA missing prescribed Terms” template.

                Hello Alland!

                I have a similar thing with a Capquest/Lloyds/Halifax muddying of waters. Capquest is chasing my Lloyds TSB card on behalf of Lloyds (Lloyds still own it), and separately, Capquest bought my Halifax credit card debt (yet refer to it as "Lloyds" in their letters). I think this is because Halifax Bank of Scotland is now owned by Lloyds Banking Group. I just have to take a deep breath and pay close attention whenever I get anything from Capquest now, but I was also thrown by this when reading one of their letters in a hurry.

                I can agree happily (almost!) about the diminishing number of letters though -- I just got back from three weeks overseas and was expecting a ton of letters to deal with on my return (to the point where I was concerned that three weeks away was too long to be away without dealing with the debt admin) but in that time I had only been sent a single "We are still awaiting documents from our client" letter from the whole of my delightful debt portfolio ...

                  Yes when I thought more about it Lloyds Banking Group did take over Halifax so that will explain why they are now referring to old Halifax accounts as Lloyds Group.
                  My overseas work takes me away for 6 weeks at a time so I always start to sweat a little as the time approaches for coming home, but I am relieved to find less and less letters awaiting my return. Still got another two years to go before I'm SB on the alleged debts, so not out of the woods yet....

                        Congrats on the 4 years countdown Allan, and just 2 more to go - a walk in the park! - the time has flown by with the odd ups and downs, but we still manage to pull through. (should be the same for me as well 2 years to go?).

                        Will we all have a party? as there be masses around that time too

                              After being away working overseas for the last 6 weeks as usual I always get a bit nervous as the time approaches to come back home and wonder what nasty letters might be awaiting me... well on this occasion only a couple. One regarding my Monument credit card account, which to date (4 yrs) I am still awaiting them coming up with a CCA, their latest letter says they are prepared to offer a 50% discount off the alleged outstanding debt of £5K. I think I will just keep waiting for the arrival of my CCA before considering their offer.....

                              The other from Capquest in reference to my Lloyds TSB Visa, (£13K ) needs a little more consideration before I respond as Capquest have now supplied a copy of my CCA & T&C.
                              Niddy considered it UE when he looked at the CCA that Lloyds sent me 4 yrs ago, I can't remember why it was UE so may be it will be wise to let Niddy take another look just to refresh him on the agreement content before I reply.

                              Not liking this as Marlin/Capquest have a reputation for being particular aggressive. So just have to wait and see what they have to say when they write to me, which I imagine won't be long in happening...
