Now I'm getting them also from another company called D&G (I think) Does this mean that First Direct have sold the debt on. Surely they can't do that if it is in dispute with the FOS can they, where do I go from here.

    Hiya, do First Direct know you're disputing this with the FOS? Yes, they can sell it but they shouldn't - however just respond to D&G with a quick letter saying the same as you've told us here, that this account was made up of charges that you're disputing with the FOS and you suggest they return the account to First Direct.

    Leave it at that.

      No I don't own my own home, but after mum died I've inherited her estate and the trust from dad which does include property that is leased out. This has been worrying me even more as I don't have any money to fight anyone with but can't sell the properties as they are already signed into 10 year leases

        I'd not worry too much about the estate as things stand right now. It is protected, plus the worse they could try and obtain is a charging order which only reserves any assets toward the loan company upon sale of house - i'd not worry too much about it at this stage.

          Sorry! Was worth looking into PPi but according to those papers, none was ever added.
          Looking back on the actual agreement I believe that the PPI was added at the very beginning and was in the region of £3k. I'm going to dig it out for you and email it to you just incase I'm reading the wrong thing.

          If I am wrong and no PPI was infact added how much do you think would be the least they would accept as an offer, my head spins with all this

            I also think PPi was added at some point, thus my probing about it all the time but according to the same peperwork you sent me it clearly shows at the top - no PPi applicable. However, that's not to say none ever was applied to the account.

            Don't worry about it, why are you so eager to settle this? Do you have an amount you can use to pay it off? What is the approx balance and what was the original loan amount? Just to refresh memory....

                  I write with reference to your letter dated 29 November 2010, finally acknowledging closure of the above numbered account - hallelujah!

                  However, you failed to acknowledge my formal request for compensation, as a result of your continual harassment which has added to my stress levels thus resulting in my overall health deteriorating - I was still fighting this with you whilst recovering from major surgery - something I am certain the press would love to hear about! You have made me both physically and mentally unstable for several months, what with my having to repeat myself time and time again to you.

                  Then you have the cheek to attempt to end communication with a silly 5 liner saying you acknowledge my comments and have closed your file. Maybe you've closed your file, but mine is wide open and will remain so until you do the right thing and compensate me for your harassment. I did suggest an amount totalling £250 which I think is more than reasonable being I could take things a lot further resulting in both the national press and the regulatory bodies being notified about this, which would ultimately cost you several times more than the paltry amount I am requesting you pay - as a gesture of goodwill, nothing more nothing less. I trust you will not let things go that far, being my final option would be a legal claim against you; you really don't have a clue what damage this whole episode has done to me when all the while it was a mistake by the gym - i'd done nothing wrong - ever!

                  I suggest you consider my request carefully, prior to trying and fob me off again as this will be my last offer to you prior to the commencement of the above noted actions, not withstanding possible legal action.

                      Can you email me the stuff they sent you ie the agreement etc that they sent you, cos it is obviously fabricated with the omission of PPi etc

                      Then i'll compare them and advise next steps.

                        The copy of the CCA they sent to me has a direct debit slip on the bottom but as mine was the Customer Copy I'm not really sure if this has been altered but the CCA copy does show the PPI its when they send the statements that the PPI is not acknowledged.

                        I've emailed them all over to you. Hope you find what we are looking for. Saint Niddy

                            I know you have many of us under your wing but did you by any chance have the opportunity to look at the original document and where I think the PPI might have been. I was just wondering what my next move might be - it's like a game of chess isn't it (pity I don't know the rules for chess though)

                              No sorry, my emails are not working, can you therefore PM me whatever it is. Thing is i'm slightly lost with it all now cos we've been chopping and changing things lol. From day 1 I asked about PPi and was sure i'd seen it, but you said not!

                              We need to take a proper look through all this and sort something out! Maybe if you done an event log for us it'd help me no end...? That way I can get to grips with things much easier than re-reading pages and pages of stuff

                                Hi, I'm back and raring to go. Are your emails working now or do you have a new email address for us to use, I've still got the sent email in my log which I can resend.

                                As for an event log, I did begin doing one at the beginning but the problem with keeping it up to date is everytime I try to type on it, it throws me back up the message as I think it's too long for the message. Don't know how to get around that
