    Who would be able to tell me exactly what payments were made, the bank via statements (would they have records back to 2000) or should I contact Barclaysloan. I've avoided asking them anything as I've tried to keep a low profile but obviously I can't any longer.

      Can I just clarify then so I can get me head around everything and explain it to OH, if we try the retrospective claim route and get it knocked back would that mean that the PPI had been invalid and they would have to refund

        Well a SAR only goes back 6 years so you need to find your own paperwork or at least sit down and think and think long and hard..... try and list things for me in a clear format and i'll sort this for you.....

        Basically try and think - hey, worse case - they reject it cos you have dates wrong - but it'd be great if you find out.... even try ringing them and asking when the last full payment was made and when the account first came into arrears - the dates should match within a month (ie. last paid January would mean arrears started in the february)....

        Play the game, get the data then come back to me... get it anyhow you can, be a cheat a liar - be anything but get the bank to confirm this to you WITHOUT giving away anything that I have told you, they MUST not know what we're doing or they will lie about the dates.... it can and will cost them £20k if they make an error or give you the date that confirms you were unlawfully paying into a debt that should have been paid for using insurance....

        DO NOT tell the bank what you need the date for - just say "cos i'm working out when I last paid" and act thick if they press.....

          Yes, spot on - meaning £6k refund plus interest all backdated plus compo - i'd still fight for full closure and debt write off. Don't worry too much about it, either way you're going to be better off - just watch this space.

            Rang the doctors and according to their computer records they only have details back to 2001. Paper records do go back further but obviously they would have to be trawled through, I assume that it's something they would do for an insurance company but not for a patient and def not over the phone.

            I was first actually given anti-depressants in April 2001 but I do remember that they had been trying to give them to me for a while and I had been trying to resist them as I didn't want to get dependant on them.

            My date for the psychiatrist was May 2001 and again in June 2001 with a letter on my file from the actual psychiatrist that I eventually saw in Feb 2002. As I mentioned earlier I had had a battle with the Chief Executive of the NHS in the area as I had been slipping through the net for about 18 months and kept being overlooked and appointments being cancelled by them.

            I would guess then that my depression had started prior to me taking out the loan as I was trying to consolodate everything but wasn't actually diagnosed until a few months down the line when realisation hit that I couldn't keep all the plates spinning that I was trying to do. This then broke me to the point the business folded and depression really hit.

            I don't know if any of this is actually helpful to you but I am trying to get all the information together for you.

              Spoke with Barclays re loan, as the account is with collections they didn't have the information to be able to tell me about payments over the phone however I asked if I could have a full statement of all payments from the very beginning of the account and was told this isn't a problem and they have requested it to be sent in the post to me.

              Fingers crossed things match up the way you hope for me.

                Hope you don't mind me commenting on your diary, as someone who has battled depression for many years I know how hard it can be. I finally came off antidepressants this summer and I'm sure that getting my debts declared :UE by Niddy was a huge factor in helping to start to sort my problems out.

                Anyway, just wanted to say that I'm sure you have a right to see all your notes, maybe someone else can confirm that ??

                Maybe ring the Dr's again and ask to speak to the practice manager, or ring the local health care trust. Please don't be put off, sounds like getting these records would really help Niddy in getting this sorted out for you.

                  Thanks MK I have no problem whatsoever in anyone joining in on my thread. My depression has majorly been caused by family circumstances and problems I had with mum, my father passing away and a husband becoming an ex followed by the collapse of my business.

                  I was told a number of years ago that it is unlikely I will ever come off anti depressants whilst mum was still alive and I had the debt problems. Well hopefully thanks to Niddy I am getting the money side of things sorted out and although it is upsetting that I no longer have either of my parents, mum joined dad in August this year.

                  My operation I've fought for over 2 years for is due to take place in less than 10 days so fingers crossed 2011 might be my year that my life can be on track and once I get there I plan to stay there.

                    Regards to getting info you can send in a SAR but this only goes back 6yrs. What barclays are doing is good of them lol. Surprised they don't want paying for it....

                      Will do, they never mentioned anything about wanting any money for it, the guy on the phone was very very helpful, never asked a single question about why I wanted it and was more than happy to request it. :-)

                      I know you are away this weekend but any chance at some point this week we could draft a letter to Robbing Way before I go into hospital

                        Guess it was too good to be true when I asked for a breakdown of every payment I'd made from the beginning of the loan. I got a stupid balance of the account this morning, nothing more nothing less. Guess I will have to phone again. Arragh wanted to try to get things sorted before going into Hospital (just incase I don't come out)

                          DOH! Course you'll be coming out silly billy..... and if not, then fook the debt! But seriously, try again and don't worry - things can wait.

                          For instance, Phoenix (on here) was in hospital for a few weeks and was worried about the exact same thing - point is, nothing happened in the time she was ill so guess what? I'm asking you to react the same, stop worrying and let things happen naturally. Your health is more important - don't forget that!

If not then I suggest you take action against them, as per my threat, to which i'd do for you if you wanted - point is they have no legal right to address this as there is no balance fully owing; I am also going for a refund of all payments made since the original cancellation date!

                                I write with reference to your repeated letters, chasing an illegible debt that you presume I owe. This is really becoming tiresome now, especially due to the fact there is NO debt to pay, and you've now left me with no option but to formally demand a refund of all monies paid to date with interest at the statutory rate of 8%; plus compensation for the extreme hassle caused to me - which unbeknown to you is having a severely detrimental effect of my long term health.

                                I shall try and explain things, slowly, to allow you to acknowledge and appreciate what it is I am trying to explain as this will be the last ever time I communicate with you; my next option will be to formally take legal action against both the Gym as well as yourselves, as their appointed harassers.

                                This all started when I joined a local gym. I had been going for a number of months, paying by direct debit and everything was fine. After some time I took ill and stopped going and cancelled the direct debit, this NEVER caused any problems and nothing was ever said about it as I was just taking a break as far as they were concerned. When I started to feel a bit better and able to return to the gym, I needed to reinstate my direct debit, which I didn't mind doing - however unbeknown to me instead of just reinstating my direct debit for the rest of the term I had originally signed up for; the gym had fraudulently started an entirely new 12 month contract - in effect signing me for an entire year again, something I did not need nor request. If I had been told this I would never have agreed to it as I knew that I was due to go back into hospital for major surgery a couple of months after my returning to the gym and as such I knew i'd never be able to return to the gym after this operation, therefore signing a new 12 month contract would have been a waste of time, money and effort for all involved.

                                Once I had been admitted to hospital I cancelled my direct debit, knowing i'd already used more than the original year contract so felt happy at cancelling my membership in line with the gym cancellation policy; not that this has any legal standing anyway, however I did do all that was asked of me. It was at this time that I was informed that the idiot behind the desk had went and signed me up to a whole new 12 month contract, knowing full well this was not what I wanted, nor was it what we discussed at the time.

                                I have, to date, written several letters to the owner of Classic World of Fitness Gym and explained all the details surrounding the mistake on the second agreement and that it should only have been a direct debit form, I explained in detail about my major surgery and also the financial situation that I then found myself in but he was neither helpful nor compassionate and all he could suggest was that I sell my membership to a family member and get them to use it instead. This wasn't an option at all for me as I do not have family.

                                Since then I have been paying a token payment of 11p per month as this is an obvious error that I could not fight until my health allowed, which is now. I now have the help of clued up legal experts who are prepared to back my fight to the hilt, this being the first port of call followed up with a complaint to the OFT for your blatant harassment and failure to acknowledge my lawful dispute, followed up by legal action for Injunctive Relief (if deemed necessary) to make you stop harassing me.

                                As for the gym themselves, I am done with them. At the end of the day, as their appointed representatives for this account you are as much liable as they are so I now formally demand that you close your file and stop harassing me. Not before you send me a refund of all monies paid to date, plus interest at the standard apr of 8% with a suitable offer of recompense for my troubles. I would suggest you consider a payment totalling £250 for me to walk away. We both know what you're doing is in fact unlawful and severely frowned upon by the regulatory authorities, therefore I suggest you close matters prior to my involving them.

                                I am going back into hospital again shortly and will not be in a position to correspond so I suggest you sort this as a matter of urgency otherwise I shall be left with little option but to assign the alleged debt myself, to a third party, who will fight you through the courts for closure. I will also seek to report this to the national press, especially when I go into detail about the adverse effect this whole episode has had on my health.

                                ;LOL ;LOL ;LOL I know Im coming out again, only booked in for 3 nights, it's a gastic bypass that I'm going for which will improve the rest of my health no end hopefully. Im keeping fingers crossed that eventually I will be able to stop being registered disabled and hand back my blue badge - start living again. Its friends of mine that have been worrying and checking that my Will has been updated (tick) daughters birth certificate updated (tick) (long story)

                                Im actually looking forward to a few days peace and quiet - plan to take Prof Layton's Lost Future with me and the entire series of True Blood/Prison Break
