                Well they've put it on hold. Fine. Have Barclays dealt with your cca request?
                I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.                     Mate presume I only read that letter you loaded, I've not read back.... call it lazy/too busy - not rhetorical

                      Ok ignore my last post, kinda got up to date already... so they have sent a LBA and you in response to that sent SH's letter, to which they now claim that sending statements is acceptable.... ermm, nope!

                      Have you actually formally requested a CCA from the OC and did they send anything?

                        Hi amte , i know you have thousands of people you have/are helping so i know you wont remember mine specifially , yes , formally requested quite some time ago , no prescribed terms , just my wifes name and address at the time 1998 , you said UE at the time and since then i have followed the process religiously

                          Dear Sirs,

                          Thanks for your letter dated xx/xx/2013, the content of which has been noted.

                          Since you clearly lack the skills to actually understand the content of what I said in my previous letter, I shall spell it out again for you.

                          I require your client to send me a copy of the purported original agreement and associated terms as per my lawful s.78 request that was made and paid for, some time ago now. They have not fulfilled this request and as such if you decide to proceed with any legal action I will immediately defend it and issue a counterclaim for strike-out based on the vexatious nature of the claim.

                          As you are also fully aware, there are set protocols in place that must be met prior to any formal legal action being taken, you are in breach of these protocols and if you do not remedy them, by dealing with my very live formal complaint, this will also be brought to the courts attention and a claim for all my costs will be submitted as well.

                          You claim in your letter that it is your client's (Barclaycard) policy to provide agreements and terms at the point of sale. That statement is absolutely absurd and clearly shows you do not have a clue. How on earth can you stand in court and say to the judge when questioned about my lawful s.78 request "well, Sir our client gives them a copy at outset..." when the whole purpose of s.78 is a formal request for said agreement? Can't you see that regardless of whether Barclays issued it or not, I want it now - not then, now!

                          Thus, I suggest you recourse this account back to Barclays because any further communication from you, whilst I have a very valid and live complaint will be referred to my solicitor with the instruction they should commence proceedings against you for harassment and breaches within Pre Action Protocol as well as being in direct breach of the SRA, OFT and Trading Standards guidelines and rules collectively.

                          For the record Barclays did not issue any such document at outset, so your wholly incorrect assumption that they did this is flawed from outset - it is known that Barclays, more than any other UK bank rarely ever issued any lawful agreement at outset nor did they safely store the documents (Iron Mountain fire ring any bells to you?) so again, I demand my s.78 request is complied with, meaning I expect you to recourse this back to Barclays and close it, your end.

                          There will be no offer of payment as this account is disputed in its entirety. I do in the meantime look forward to your letter confirming you've passed this back to Barclays and will not contact me again.
