Re: DGJsaver UE Diary
Hello all
Hope everybody is well!!
Just a quick addition to this Barclaycard diary!
Last status is deadlock , provide the true copy etc ,moved house , twice since , they have tried their luck sending a letter to an old address ,which just by chance we ARE at as we have just moved there to look after a relative (carers) saying call us , we can’t disclose what about etc till you do , my wife bless her , very innocent did just that , even confirmed our phone number! , she did NOT acknowledge anything account wise though...
Since then, I have had BT change our number because if they started calling it would make things very tricky, basically our relative is infirm, disabled and suffering dementia, we try to not let anyone call as it upsets her, never mind Frederickson’s!
So, see attached arrived this week..., what should my response be? , last acknowledged anything to do with it (as in made a payment, Jan 2010), should I ignore, reply with anything?
Any help appreciated!
And merry Christmas all, don’t let the b*stards get you down!!Attached Files

Re: DGJsaver UE Diary
I just had a read through some of Pauls advice....going on the below..
2.1 point 5 - isnt on the letter ?
and 2.2 point 3 , surley 7 days is just a scare tactic....?
************************************************** ********************
2. Claimant’s letter before claim
2.1
The claimant’s letter should give concise details about the matter. This should enable the defendant to understand and investigate the issues without needing to request further information. The letter should include –
(1) the claimant’s full name and address;
(2) the basis on which the claim is made (i.e. why the claimant says the defendant is liable);
(3) a clear summary of the facts on which the claim is based;
(4) what the claimant wants from the defendant;
(5) if financial loss is claimed, an explanation of how the amount has been calculated; and
(6) details of any funding arrangement (within the meaning of rule 43.2(1)(k) of the CPR) that has been entered into by the claimant.
2.2
The letter should also –
(1) list the essential documents on which the claimant intends to rely;
(2) set out the form of ADR (if any) that the claimant considers the most suitable and invite the defendant to agree to this;
(3) state the date by which the claimant considers it reasonable for a full response to be provided by the defendant; and
(4) identify and ask for copies of any relevant documents not in the claimant's possession and which the claimant wishes to see.
2.3
Unless the defendant is known to be legally represented the letter should –
(1) refer the defendant to this Practice Direction and in particular draw attention to paragraph 4 concerning the court's powers to impose sanctions for failure to comply with the Practice Direction; and
(2) inform the defendant that ignoring the letter before claim may lead to the claimant starting proceedings and may increase the defendant's liability for costs.

Re: DGJsaver UE Diary
I think you can ignore this. Please don't mix a clear LBA with a basic debt letter
No need to involve Pauls LBA action at this stage.I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.
