I wouldn't ignore a direct threat of court, especially from a slime ball such as Carter who will go for Judgment in Default if he thinks you are hiding. Now is your opportunity to take an advantage by pointing out the pitiful nature of that letter, and introducing a threat of costs for non-compliance.

You need to compose a letter around the outline given here -

giving Carter a breakdown of the ongoing dispute. From what you have posted here, it is impossible to advise any further as we don't know whether this is UE, whether the default was botched, or whether there were unlawful charges added.

Thanks Scab , this account goes back a long way , last payment made Jan `10 , have never received the correct set of docuemnts required from barbclaycard , then nor from any ccompany who have had the pleasure of contacting us since

The nearest they sent was a generic agreement with my wifes name and address on it , no signature etc..

i will have a muse about this , and have cut and paste the above template into a word document to spend time on later

The one thing Carter loves is an easy target. I've written defences which have seen him off in the past, and it was like pushing over a wonky teddy bear. The first sign of resistance, and he capitulated at the allocation questionnaire stage.

On this forum, letters based around that outline have been successful in seeing off Freds and Carter before. Obviously, there are never any guarantees, but with the outline you describe above it is hard to see anything other than a positive result.

No problem...they do tend to leave sneaky codes along the bottom and bank payment refs in the 2nd page so I've removed that as it's not needed.

specifially guys , im looking for reassurance on the exact terminology i should use to describe the OC not complying (and any company thereafter) with the credit agreement true copy request dating back to january 2010 , i want ti to NOT look like it was written by a simpelton!!

The main crux of my dispute is failure to provide a certified and acceptable true copy of the credit agreement Barclays claim exists and failure to provide a TRUE copy places this account in dispute

No that wont cut it, you need to change that, hopefully SH will come back and help you.

You should say something like, on XX/XX/XX i wrote to barclaycard requesting a true copy of my credit agreement persuant to section 78(1) of the Consumer Credit Act 1974, and to date, they have failed to provide this. Clearly without a true copy of my agreement this account remains unenforceable inline with section 127(3) of CCA1974, and furthermore without a true copy i am prejudice"

(Check the correct CCA1974 references as that was off top of my head, do NOT send this paragraph without first speaking to a mod to confirm or alter)

Yes, SXGuy has got the correct sections of the CCA 1974. So, what are the exact circumstances here? You have made a request under s. 78, and received nothing back but reconstructions which do not comply with the stipulation that a 'true copy' must be provided.

Anything else I need to know?

I can come up with some exact wording if you want me to. You'll also need to proof read and correct some errors in Paul's outline! There are multiple instances of a lower-case “i” being used where an upper case one is needed, and “spectacularly” is completely mis-spelt.

If you want me to produce a finished article, just tell me everything you can about the dispute, and let me know.

disaster , the relative we live in care for , died ealy this morning after being taken into hospital yesterday so my head is all over the place!

all my files are at work , and were busy at the undertakers etc , nightmare

the circumstances are as you say, we requested the coomplete and true coy direct from bcard in Jan 2010 and that is the last time we made any payment or acknowledged any debt , since then we have been batting dca`s away with various templates at, one dca sent us a template agreement with my wifes name and address on it , no signature , no terms etc , Niddy saw it at the time and said its not satisfactory etc , and ever since then we hadnt really heard anything , somehow they tracked my wife back to where we are now , which is where she lived as a kid/young adult...

hope you can help , if you can , i can try to get to work later or tomorrow to get the dca letter and add their refs to any doc you send me , then i can record deliver before the w/e

OK, sorry to hear that. I'll come up with a final letter that you can just copy and paste as is. The last thing you need at a time like this is pond scum like Carter causing even more trouble.
