Hiya, well done for not freaking out about this. Ok you need to send a couple of things, so it all tallies together.

First, send this with a copy of the letter confirming no agreement can be found: ---> viewtopic.php?p=20195#p20195

Second, send this a few days later, so they recognise that you're clued up and will not be pressured: ---> viewtopic.php?p=2319#p2319

thanks scorpio, thought they were at it, a year ago I'd have had a heart attack.
they're not even threatening us in the right legal system as there is no suck thing as a charging order in Scotland, and this from the Bank of Scotland!!! nae wonder they were burst!

Hi Dopey (just some words about Blair Oliver Scott AKA Bank of Scotland)....they've sent a letter with Intend court action to me before....(its a scare letter, they are sending) i sent this.... viewtopic.php?p=2319#p2319
and never heard back since, as they passed it back to BOS who....(as i had letter from BOS saying that they can't and wont Enforce it)...i am now dealing with Rob[size=5]bers[/s]inson way...who just keeps on sending letters random to say that they are waiting for there client to send details to them and account is on hold ;Hmm (3x letters so far to tell me that).

Good luck & dinna worry, as no doubt Niddy will be along to correct if i given link above in correctly?

They won't reply to specific matters, then they go on to say that the insist that the agreement is valid, then the usual threats, They keep saying its compliant cos they've sent it (Which they haven't, only threats)
They are also questioning my advice again!!!
at no point do they say the agreement is enforceable, just valid

Sept please pay letters from Blair Oliver Scott
Oct sent "sold while in dispute"
to-day more of the same, they are going to send someone around and get a charging order (don't think there is such a thing here)
Can I send the letter saying its unenforceable cos you said so?
Just send one of these: ---> viewtopic.php?p=20195#p20195 with a copy of their letter saying no agreement and forget it. The daft buggers - plus their letters are coming from England and they forget you're in Scotland so best of luck at getting a CO against you - I thought they were called Inhibition Orders!! Muppets!

    * for others that wonder what this is, basically (from my knowledge) it is very similar to a Charging Order but the main difference is that an Inhibition Order is not on the house - In fact it is on the person and inhibits you from selling the house without paying the debt owed in full..... so same theory but slightly different, all the same!
