    Hi Elsa

    Just to let you know that the Court of Protection sent me forms to give hubby's daughters chance to object to me taking his affairs on. They don't and have signed up so all went off recorded post so will wait for the next bit. As it is the festive season will probably take a couple of weeks.

    A piece of good news - although I lost my job have got one this week! Wont be rich and retiring to the sun lol - but at least I will be able to keep the house for hubby to come home from hospital to!!!

        Aww well done honey!!! Glad the Court of Protection application is progressing too. You relax and try and enjoy Christmas as best you can, don't make the mistake of neglecting your own needs.
        We'll get ready to sort things out in 2015.
        I'll still be around and checking in over Christmas so don't hesitate to shout if anything urgent comes up.

            Brilliant news about the new job!

            We'll get cracking on your mortgage in the New Year.

            If your husband is entitled to ESA (I've read your email) then you ought to get 50% of the mortgage interest paid by the DWP under the SMI (Support for Mortgage Interest) scheme since it's a joint mortgage. That should half your monthly payments if the lender can be persuaded to change it from a repayment basis to interest only. That's what we'll aim for anyway.

            Maybe give them a call on Monday to tell them you'll be claiming DWP benefit and ask them to send out the relevant paperwork etc.

              Hi Elsa
              Long time, no speak - hope all is well with you.

              I have had two replies from Cabot Financial, one for me (RBoS 3035.97) and one for hubby (Barclaycard 2695.20). Both state the same - the debts are unenforceable but I should contact them to set up a payment arrangmentas I am obliged to repay the balance. I have added the notes to my UE diary.

              A couple of others are still chasing paperwork.

              I have heard from the CoP and my paperwork should be completed in 6-8 weeks to deal with hubby's stuff as his guardian.

                    Arrow Global on hubby's account have written and have said the amount on his loan is £7957.78 and will become payable comprising interest and costs depending on what enforcement action is taken against him.

                    They have enclosed a copy of the agreement and are looking to outsource the account to a specialist third party. If I would like to make payments in the meantime they will accept them.THis was M & S Finance originall.

                    M & S and More account also with Arrow Global are still chasing the CCA request and have written to say so.

                      I have had a new letter from DLC dated 08/04/15 - they are happy to accept my offer of payment (nothing new from me this is the existing DMP through Stepchange and currenlty a holding balance of £1 per month) but they intend to seek a county court claim against me with a view to obtaining a judgement.

                      They say they want a charging order against the property to obtain security for the outstanding balance. This for DMP that has been going for years!

                        That's why we don't tend to encourage DMPs.

                        Which debt is this for Smallpaws?

                        I'm not sure what you can reply with. I'll ask PlanB and Elsa to have a look in as they're the ones who know about legal stuff.

                          Just to clarify...Is this your own debt or Hubby's? Is it the Capital One Credit Card?

                          Did you ever get a response to the CCA Request? If so did you send it to Niddy and what did he say about it?

                          Just catching up with things after a virusy thing last week, I'll be back tomorrow morning to see your answers and catch up with your situation.

                            Oops- sorry Elsa. This is one of mine and yes originally from Capital One. (current balance 6987.45)
                            They said they wanted a County Court Claim 07/11/14, I sent a CCA request acknowledged on 10/12/14.
                            They said they were following up on this on 21/01/15 and again on 19/02/15.
                            on 10/03/15 they said my account was onhold but this had now expired.

                            I have had no cca response and this is the latest attempt to talk up a County Court Claim.

                            Hope you are feeling better from the virusy thing - they aren't friendly! x

                              If they've not complied with your CCA request they cannot get a CCJ. That won't necessarily stop them issuing proceedings but the FCA makes it clear that they shouldn't.

                              Have dlc sent you anything at all? Maybe a recon of your Capital One application?

                              Can you email Niddy/Elsa/me a copy of that letter (or any recon documents which you may have been sent). It doesn't sound like a Letter Before Action but let's see it just to be sure.

                                please don't bother emailing me the paperwork you've received. There's no need (it just creates unnecessary work for me). Until they comply with s.78 they cannot enforce.

                                Hence I'm not concerned as to the letter they've sent. All you need to do is respond with a new CCA request. That is paramount right now. We need to establish what info they DO hold. Pointless sending an LBA response too. You need a CCA. ASAP
