        Quick up date.
        got a letter from Arrow saying that they received my complaint and would have to contact the original creditor, they say they will get back to me in 8 weeks.
        Will update when I receive a reply.

          I've had a quick read of your thread tonight for the first time and I sense you're worried about the worst case scenario which is a charging order on your home even though you haven't even got a CCJ against you yet - and probably never will. You also say you've had bouts of depression in your life. Who wouldn't with creditors making all our lives hell.

          Can you just clarify whether this debt (MBNA/Arrow) is in your sole name and whether your property is also in your sole name or joint names. It's nothing sinister. We need to establish the situation so we can give you reassurance that if the worst happens (which I doubt but you seem to anticipate that it may) it won't be as bad as what you're expecting

          Is everything up-to-date with your mortgage because that's a priority debt? I'll try to help you on that score if you have problems

            Hi PlanB,
            the debt is in my sole name. The house in joint names, so they may only be able to register a restriction if the worst did happen.
            mortgage, council tax is up to date, struggling with the water but paying a little each week.

            what gets me is I never signed any agreement for credit other than my mortgage that puts our home at risk!
            its shocking that that anyone can register a charge/ restriction on a home when your paying through the nose for supposedly unsecured credit.

              The reason I worry about Arrow in particular is they've gone PLC, they wouldn't have got a credit line from mainstream lenders without carefully picking the debts they purchase being from home owners, well bank owners until it's paid in donkey's years lol

                Hi peeps,
                I received a reply dated 28th July( shock), daft new postie put all the mail through wrong letter boxes but the neighbours have been away for a few weeks, hense we've only just got
                Ill try and scan it later on and drop you an email Niddy if thats ok?

                Basicly says they want income and expenditure blah blah, nothing about medical notes in this one, says they have acted correctly and not harassed me....
                funny they never mentioned Bryan carter in there response, just Frederickson and themselfs, i wouldn't mind sending them a SAR to make the buggers send me everything Carter sent me.

                    Can you please clarify your financial position - are you saying your wife is on a DMP and you only have this one account worrying you? Are you on a DMP or literally, just paying the £5pm to this account?

                    Just want to understand where you're going (long term) prior to suggesting any reasonable help with this, for instance I was thinking of utilising CFS (with Elsa's help) to work out an I&E but that depends on other debts and what you actually want to achieve from this.

                    Don't worry, nobody will be doing anything - it's threats, continue with the payments and they'll struggle to get any enforcement against you.

                      HI NIddy and thank you for the response.
                      i wish it was just this account lol
                      to clarify, my wife has been on a DMP for 4 years! In that plan they include her tax credits as she has a part time job, if they were not Included there would be no DMP as not enough des possible income.

                      her tax credits are paid into my account as our friendly bank took them from a joint acc one week towards a cc debt.

                      i had 2 MBNA accounts both sold to Arrow global guernsey, they let Frederickson run them as MBNA were, they agreed to £5 a month for each debt.
                      i also owe
                      barclays cc still with them, they've accepted £8 month for 5 years! No default.
                      mk recoveries old BC CRedit card £5 a month accepted, also offered 50% off if I pay it off early! tried to get it to 30% as my sister would sort it but they refused and have been fine.

                      now the Arrow accounts which were MBNA are for £4600 (this one were dealing with now!)
                      The other one is for £10k they haven't written about that yet.

                      i also owe shabby national £3k but I explained things to them regarding my health and they were fine, said don't even pay us £5 but keep us informed, they just said we will gradually reduce your agreed Overdraft. Which they have to be fair to them.

                      to be honest Niddy I've just been trying to pay what I could and then further down the line if things improved I was going for low ball full and finals, but to be honest that's in the distance, I've genuinely been quite not well mentally and over the last few years. A bit of putting my head in the sand.

                      What's worrying me is they want my bank statements which include the tax credits, there used against the wife's DMP, she's shit with money lol, saying that I ain't that good either if you read above lol but a lot of it was health issues!

                      hope its a bit clearer.

                      PS I took a punt years again to go with a tracker mortgage which I got hammered for in the beginning but it's kept us a float to be honest.

                      if I sell the house I can't get social housing, I wouldn't get another mortgage and would find renting privately a nightmare due to the credit checks!!!
                      hence the concern

                        Ok so why don't you and your wife do a joint DMP? Sort it all centrally at the same time with one single payment...?

                        Regards the house, if you sold it then credit checks are not the same and you'll quite easily rent privately - they cannot perform a full search like a bank, they only get to see public data - even the new landlord checks don't show everything and they are quite dear. However a joint DMP may be best.....

                        If you did that insist they utilise the Common Financial Statement and take into account the trigger figures - Elsa can help you do a dummy one via email so you can get the most out of any income left over...... just PM her if you're interested

                          What there saying is they won't consider a payment plan without me ticking all the boxes agreeing to thre conditions, like they can show my details to third partys! One all the bills are in the wife's name, two her tax credits make it look like I have more money then I do.

                          i can easily show them a benefit letter because they've just transferred me to ESA without a medical from Incapacity benefit. So that's not an issue.
                          but they have taken the account indoors so there dealing with it now rather than Fredericksons.

                          i was going to SAR them because I'm sure it wasn't right that I was getting letters from Arrow global guernsey arrow global Manchester Frederickson and Bryan the arse carter! But I fought him off.

                              thanks Niddy, but hers has been reduced by a hundred quid this last year due to the cuts that have kicked in so I it gets reduced again some of her creditors may not agree to it, that's why I've been doing it all myself from my point of view and it's been going ok apart from this mob.

                              renting privately is the last thing we want to do, our daughter attends a school that specialises in learning difficulties which we fought tooth and nail for, for years and she's coming along much better, if we rented privately it wouldn't be in this area due to costs in London. So that's the last thing we'd want to be honest.

                              its a mess a worrying mess!

                              As its unenforceable I'm sticking to that but am still going to pay something towards it, in case they go legal and a judge disagrees, at least it shows I've made an effort to pay something.
