    This is the template letter to send when a dca threatens to send doorstep collectors.

    Doorstep collectors are NOT bailiffs and have no right to enter your home. What did your mother say to them? If any call again just tell them, it's up to you whether to do it politely or not, to go away and then close the door on them. If they refuse to leave then call the police as they are trespassing.

    In four years I've only had one doorstep collector and he left without a murmur.

    06/03/13 - Recieved SAR from HSBC regarding business current account. Original Overdraft was £4250. Account went over to £25k at one stage with Charges and interest. Payplan sent a letter to Ombudsman in 2008 for interests charges to be stopped. Intially rejected by HSBC in 2006. Account is back down to £13178. so seems they must of took charges and penalties off i presume. Need to confirm with PP.

    06/03/13 - CCA request sent as per template on Overdrafts section

    07/03/13 - reduce payment to £1

    26/03/13 - Received letter back from HSBC. "Thank you for your letter dated 06/03/13. we are currently looking into this with the relevant department. Will get back to me with a full response once investigated"

    12/04/13 - Recieved letter from HSBC stating they are looking into my complaint. estimate response by 10/05/13.

    17/04/13 - received letter from HSBC. May i advise you, the consumer credit (EU Directive) 2010, which inserted sections 74A and 74B into the consumer Credit Act 1974 (hereinafter the Act), does not impose a duty on a crditor to provide copies of the historic overdraft agreements. Nevertheless we enclose a copy of the facility letter dated 12/;03/08, being a copy of the overdraft agreement,for your info.
    As the requirements set out in sections 74A and 74B of the act did not come into affect until 1 feb 2011, they do not apply to the agreement in question. Notwithstanding, the facility letter contains information which would in any event comply with the newly inserted provisions.
    as to your contention that the bank is under a duty to furnish you with the information required by the aforementioned sections on annual basis, we cannot agree. These provisions only apply to existing and prospective overdraft agreements.
    The balance outstanding on this account arose from the agreement entered into in March 2008 which was fixed in duration until 19 March 2009. as such, this debt relates to a historic OD agreement and the facility is no longer available. Therefore, the bank is not required to provide an annual statement relating to the current OD agreement as there is no such agreement in existence.
    At this stage we would like to point out that upon the account closure in March 2009, the balance outstanding was transferred for recovery to Metropolitan Coll and interest and charges have remained frozen. Whilst i appreciate that this may not have been the response you may have anticipated, i trust this serves to clarify the banks position on the matter.


    18/04/13 - Letter addressed to wife. "Response to a request pursuant to Section 77 of the consumer Credit Act 1974. we write to your letter dated 25/01/2013???. in normal circumstances the request you have made under section 77 off the CCA 1974 is not valid and HSBC has no obligation to provide the documents you seek. This is because the info relates to closed /repaid products that are no longer in force.
    However we have assumed that your request for info is likelt to bin relation to obtaining details of PPI that you held with HSBC...goes onto mention CC that they think i have held with PPI. return my £1 postal order for safekeeping.


    29/05/13 - Letter received from Metropolitan Col stating "you have not made a suitable arrangement to repay the outstanding balance on your account. Must call us asap. we may be prepared to agree a discount to your balance. They have increased the debt back to £20,834 from £13k. Gonna ignore for time being

    26/06/13 - Final demand. Despite making several attempts to contact me. if we do not hear from you in 7 days we will take further action against you to recover this amount.

    17/07/13 - Two Letters received from Metropolitan in both names advising account has now gone to Central Debt Recovery unit.

    27/07/13 - Limited Discount offer. We have written to you on previous occasions in connection with your debt. We understand you may be experiencing financial difficulties. Your account is being prepared to be referred to a debt collection agency who may call at our home. With this in mind our clients are prepared to offer you a generous DISCOUNT of 40% in full and final settlement, subject to payment being received within 10 days.

    18/08/13 - Letter from Metropolitan. Please be aware your account is today being referred to Wescot Credit Services Limited, who will be contacting you within the next 14 days. They have been selected to work with you to help understand your present circumstances.

    24/08/13 - Letter from Wescot Credit Services. we have been instructed by our clients to collect outstanding balance. To avoid further action you must contact us asap.

    09/09/13 - Letter from Wescot. Final Notice...Our latest enquiries have now confirmed you are still resident at this address but we have not received a reply to our correspondence. Contact us in 10 days or further collection activity will be taken to recover the full outstanding balance.

    13/09/13 - Letter from Wescot. 20% reduced settlement. Contact us by 23/09/13 to take this marvelous offer.

    29/09/13 - letter from wescott. We understand that there are many why you have not responded to us in relation to this account...we can help...Blah blah....Gonna ignore

    07/12/13 - Letter from 2F. Confirmation of residency. Contact us asap

    08/04/14 - Letter from Moorcroft. Your account details have been passed to us from HSBC. We offer a flexible approach to paying. We Will contact you in next 7 days by letter or phone to discuss your repayment.

    25/04/14 - Letter from Moorcroft. We have not heard from you following our recent letter. Our aim is to establish a repayment plan that you can afford and maintain. Please reply within 7 days. Other options include instruction of local agent and the possible continued recording of an adverse entry on your credit file detailing this default.

    09/05/14 - Letter from Moorcroft. Monthly installment offer. Please contact us.

    Hi Niddy,
    Seems like your away for awhile. We talked about leaving this account as it is to see what happens. This is our biggest single debt. Shall we still keep quiet as of yet and see how it plans out?

    07/03/13 - Stopped payment

    08/06/13 - Letter received from CL finance that we have failed to make agreed payments. We need to make payments within 10 days otherwise termination of agreement and a doorstep visit to collect payment.

    12/08/13 - Letter received from HC & Co Solicitors. notice of pending action. we have been instructed to issue a claim against you in the county court in respect of above debt. Should you fail to respond to this letter, a claim will be issued against you without any further notice. Our client has asked that we take this final opportunity to remind you off implications of action being taken against you through court. Need advice on this one.

    23/08/13 - Sent letter regarding my CCA request not being fulfilled. This letter was returned this morning. address matches that of Howard Cohen solicitors. Rang automated system for track and trace and went online and it says letter still in system.

    13/11/13 - Letter received from HC & Co Solicitors. Notice of pending legal action. we have instructed to issue a claim against you in the county court in respect of the above debt. Should you fail to respond a claim will be issued.

    15/02/13 - Letter received from Robbin Scum Account has now been passed to us to act as collection agent. Please contact us in 7 days. Gonna ignore.

    24/02/14 - letter from Robin Scum. Please contact us for a discussion regarding this debt. Gonna ignore

    Hi Niddy,
    My pleasure about donation. Will probably use the service sometime in future so im just putting a little aside for when that time arrives. Lots of threatograms coming through post at moment. Have a little pile i need to go through today. But feel so much in control thanks to you and guys on site. Probably need some advice from you soon.

    If you have real proof then - trading standards and Regulators also bank/Police (fraud)

    What recourse do we have if they do setup DD without authority. Surely they can't forge a signature on a DD mandate form?

    Lots of these Robinsonway/Hoist letters about

    One thing to be aware of is Robbersway living up to their name have been setting up DD's without permission. Has to be data from Lewis but all the same worth keeping an eye out while it settles down.

    07/03/13 - Word back from Niddy. Seems like the CCA is enforceable :-(

    02/07/13 - Letter From CL Finance. You have failed to make agreed payments towards the concessionary arrangement on account. We require payment in 10 days of the date of letter. Going to ignore.

    07/02/14 - We write to inform you by an agreement dated 13/12/13 , CL finance (part of Lewis Group) has assigned all of the rights, obligations and benefits associated with the above account to Hoist Portfolio Holding Lts to whom all monies are due. Please note Robbin Scum are now managing your account on behalf of HPH Ltd. please pay the. Gonna ignore.

    Hi Guys,
    That time again of updating my dairy of the endless amounts of threatograms. This one puzzled me as Robbin Scum are stating that they came and made a doorstep collection. None of family have dealt with them. You reckon they are just saying it to make me ring up and question them. In the pretence that it will set statue barred clock back to 0?
