    Well you're off to a good start if you sent a s.78 CCA request in March 2013 which it's still outstanding. .

    Can you just clarify that you've sent nothing to anyone since April 2013? Or have you replied to any of those six letters sent since January this year?

    Hi Niddy,
    Thanks for that. Will get in touch with Andrew. Dont seem to be recieving emails when people respond to messages. Got more pressing issue to deal with first

    01/10/13 - letter received from Howard Cohen Solicitors stating that they have been instructed to issue a claim against wife at the county court in respect of the above debt. Should you fail to respond to this letter , a claim will be issued against you without further notice.

    29/01/14 - We write to inform you by an agreement dated 13/12/13 , CL finance (part of Lewis Group) has assigned all of the rights, obligations and benefits assoicated with the above account to Hoist Portfolio Holding Lts to whom all monies are due. Please note Robbin Scum are now managing your account on behalf of HPH Ltd. please pay the. Gonna ignore.

    15/02/13 - Letter from Robbin Scum. Your account has been passed to us by our client to act as a collection agent and well will be now be dealing with it. Please contact us in 7 days.

    24/02/14 - letter from Robin Scum. Please contact us for a discussion regarding this debt. Gonna ignore

    22/03/14 - Letter from Robinscum. Pllease contact us.

    11/04/14 - Letter from Drydensfairfax. We have been instructed by our clients agent Robbin Scum. Please pay within 10 days or face further action.

    05/06/14 - Letter from drydenfairfax. Unless we receive payment for full amount we will issue proceedings in county court with a view to a CCJ.
    Hi Guys,
    Have received County Court papers relating to this account dated 30 September. Little worried because this is first time in dealing creditors. Can someone please advise?

    What is your timescale for negotiation?

    If you're intending to extended your property then you may need planning consent which can take months to obtain (depending on the permitted development issue).

    How long ago was the CCJ and has it fallen off your credit file? This matters because if you agree a F&F you may get the entry marked "part-settled" but if the CCJ was more than six years ago it'll have fallen off your CRA file anyway meaning a re-mortgage application is more likely to succeed.

    Who is your current lender because they really would be the best option to approach for a further advance unless their interest rates are punitive which is why you want to remortgage away from them.

    A lot of questions, but the homework is important.

    Have you approached the holder of the 1st charge to see whether they will lend the money for the extension. You will have judgment registered against you so this might be a non starter.

    Was it a joint account? If so then who was issued a claim, both parties or just you? Likewise, re assignment - was both parties (you & partner) told of assignment and is it lawful?

    they applied for a full CO against me when house was in joint names. Unless the rules have changed it used to be that they could get a full CO but it acted as a restriction.

    Hi, I thought that interim COs were obtained x weeks before they apply to have a full CO. I had an interim one granted then went to the application for the full one which I challenged and had removed from my records. I don't know if there is any different implications between the 2.
