Please note that your refusal to address my legitimate (and it has to be legitimate) dispute, as well as your continued harassment will be kept in file and produced in any defence should you initiate a court claim.

    Or words to that effect with the assistance of the legal minds on here!

    You will then have much safer ground as you are putting the ball in their court. And they don't like to play ball.

    They do like to play with their own balls though thats another conversation.......

    I couldn't agree more SnV. Once you start going at them with legitmate disputes they do seem to back off somewhat.

    That is mainly down to laziness and not having a clue what they are talking about half the time

      You also need to be clear about when in 1985 your card was issued. Pre May 85 ( I think it was May ) they do not need to respond in the same way, as CCA 1974 changed in that year. S 78 was introduced.

        Thanks Vint - I did read that and had a bit of a wobble but according to my paperwork it was 1st August 1985 - phewww so glad about that one and as far as I remember I didn't apply for it was just sent it my ex husband was a TSB bank manager at the time!

          Hubby has a lloyds CC account from when it was TSB he didn't apply for it either, it started life as a debit card and transformed into a visa card some time later, think he was just asked at the bank if he'd like one, we have sent a CCA request and they just sent back typed T&C but it has this address on them and not the address where we were living at the time it was opened, they also state we would have signed an agreement and will send it when they find it, so any DCA that takes it up will always get a SWID letter

            I hadn't thought about where I lived when I took it out it was my first house a long way away from here - it will be interesting when I apply for my CCA

              It's a funny old thing that the banks think they can get away with stuff like that, anyone else trying that on would be accused of fraud....

                Sometimes it makes you feel like writing back and saying, thanks for your letter, i can asure you, i would have laughed and spat in your face.

                Thats about as likely as them finding this so called agreement.

                  19.02.13 I received a letter from Marlin today confirming that they do not hold my information on file therefore they have requested a copy of the Agreement, Terms and Conditions and statement of account from the original creditor Barlclays Bank Plc T/A Barclaycard and we will forward to you upon receipt.

                  Interesting as it was an egg card not ever had a Barclaycard!

                  I will update when I hear more.

                    Hi Jane,
                    Barclaycard bought the Egg Card business from them, hence why Marlin say they will contact Barclaycard for your CCA info and not Egg.
                    It can be favourable for you when accounts change hands as it usually makes the paper chase longer as they attempt to come up with the correct documents.

                            Some of the letters I have written would make your toes curl they have been that rude. Of course unlike you I do not really care what they do to me, if they try for a CCJ I will be a pain in the arse to them , if it's a SD I will say thank you very much

                              Update - Account now closed and settled 04.04.13 email to confirm they will update my credit record that this is now satisfied.
