    Arrived home this evening to find my postal order returned by Marlin Financial Services and a letter confirming receipt of my postal order but stating that the order has no payee. They have asked me to kindly to amend to Marlin Financial Services and return to them to enable them to comply with my request.

    I thought I would get my daughter to fill in the Payee so its not in my hand writing, I did the same with the envelope, but should I resend the whole letter as I don't want them to credit it to my account? Am I being over suspicious?

      Hi Jane

      If It were me... I would rewrite the letter to explain that I originally sent it xxxx Date and confirmed received by you on XXX date. Then as before, The normal format letter - Sent recorded delivery. Otherwise if you just sent off the Postal Order they could say it did'nt accompany the request and just credit it to the account.

      That way there is no wriggling out of the request being served in full with payment - Gives them no way to go on this!

      It could be a genuine thing that they dont want to ammend the postal Order..... But more likely it is a delay tactic to give them a few more days to find the agreement ect

      I've got no personal experience of "Marlins".... Yet..........

      But from what I here.... I would not put it past them

        Thanks Spud, I am a little nervous of them after reading some of the stuff on here and elsewhere on the Net.... I will send the letter off again tomorrow 2nd class recorded and await their next response.

          Hi Jane..as above but just put a copy of the original letter in and a brief cover letter in reiterating that the enclosed PO is for the Statutory fee for the CCA request previously sent on xxx

            Dont be nervous. Deep down they are all the same and all governed by the same rules.

            Some just push it further than others and are more slippery. This one is just very slippery hence named after a bloody big fish.

            But they all want easy paydays really.

            You are doing grand we are all here supporting you.

            It takes a mindset change to go from not dealing to dealing with stuff. That takes time as it feels alien at first.

            Just get them letters and emails dealt with as and when they happen. Keep the papertrail going. Keep the team on here updated. As you start to put them on the back foot there is always screams of not fair you aint playing by our rules anymore. Its normal.

            But eventually you will start to tie them up in knots and they will start to go after easier prey.

            Its the nature of the game.

            You might not feel it but you are doing fine.

              1.02.13 - Received Letter from Barclaycard and Marlin stating Marlin now "owed" account

              11.02.13 Sent off CCA request

              13.02.13 - received letter from Marlin acknowledging request and asking me to return the postal order crossed and made payable to themselves.

              14.02.13 - Got daughter to write their name on postal order - send copy of the original request and a cover letter explaining that the £1 was a statutory fee for the CCA as per my letter of the 11th. Posted recorded

                Received a letter acknowledging my CCA request from Lowells re Capital One account - they are applying to my original lender and will let me know when they get it or if it will go over the 12 days This is the debt they have issued a SD on.....

                    Hi all,

                    I haven't had any correspondence for a while from 2 of my credit cards - the Barclaycard (have never taken out a Barclaycard but am assuming it is my old Morgan Stanley card) has actually marked my Credit record "gone away" the other is a Lloyds TSB card which still shows as TSB but I did have a letter in September 2012 from Iqor (card was started in 1985).

                    Should I get the ball rolling with sending a CCA request to these last two now? I am just mindful that by ignoring on of my other cards I have got myself in the SD pickle and would like to avoid that at all costs - I defaulted on both in Oct/Nov 2008.

                    Would you send off the CCA requests now or let sleeping dogs lie?

                      Think the advice is dont poke what isnt barking. It could bite.

                      The pickle was from what alot of us did which is ignore. So you in the same boat as many of us were to start with.

                      You now here and ignore isnt what happens. Just dont write back sometimes lol.

                      Unless anyone else has better advice I would be concentrating on the SD and come back to these when that has been resolved one way or the other.
                      But others might advise otherwise.

                            The industry feeds on fear and ignorance.

                            Am sure you wont be the last to ignore something. Probably find the vast majority on here have hand on heart not followed something up they should have.

                            Early doors its a mindset change to do stuff the institutions and society have ingrained into what you shouldnt do.

                            There really isnt an institiution which time and again goes the extra mile to help someone who has fallen on hard times. Check the tumbleweeds running through the praise section on this website.

                            And over time you start to realise how bent they really are. And for every person who gets away with a technicality because they couldnt be bothered with the law we should all rejoice.

                            The sad thing is they are learning they are adapting and they are closing loopholes. Thats their first instinct not one to help someone who has fallen on hard times.

                            But you taken the biggest step and as Elsa says no one be sneaking up on you now.

                              Remember when dealing with DCA employees - they are lazy.

                              So make sure that the letters you send them have a valid dispute for the debt - UE, unlawful charges, incorrect balance, incorrect interest rates etc.

                              Invariably they won't address the issue as they are lazy. Its too much effort. Its far easier to go off and intimidate someone than actually carry out an investigation, costs less money too.

                              So when you get the next templated letter from them (which you will), you could write back and state 'you have done nothing to address my dispute stated in letter of xx/xx/xxxx. Please stop sending me template letters that do nothing to address the matters raised with you. I will not engage in any further correspondence until such time you comply with my reasonable request. Please note that your refusal to address my legitimate (and it has to be legitimate) dispute, as well as your continued harassment will be kept in file and produced in any defence should you initiate a court claim.

                              Or words to that effect with the assistance of the legal minds on here!

                              You will then have much safer ground as you are putting the ball in their court. And they don't like to play ball.

                              They do like to play with their own balls though thats another conversation.......

                                I definatley won't be poking this big bad dog with any sticks until they come knocking. I have a feeling this lot would send in the pack if you started poking to hard.
