    Now I haven't CCA'd them yet and this goes SB in Feb 2015. Would you wait for the external debt collectors to contact me and then CCA them? The debt is for over £6000.

    Well true to their word Cabot have sent a letter with a letter enclosed from Mackenzie Hall - Cabot's letter explains that Mackenzie Hall will be in touch Mackenzie Hall's states that their client knows of no valid reason for non-payment and that they want to help me - they suggest I get in touch were their fully trained advisors will discuss the options open to us! If they do not hear from me then collections contact will continue which will include further letters and telephone calls.

    Still haven't CCA'd anyone for this card...... is now the time do you think? Looks like it will be SB in early 2015..... don't want to fall at the final hurdle... how good/bad are Mackenzie Hall?

        There's always something to bring you back down to Earth. While I've been dahn in Saafend enjoying a superb birthday, for other people the clowns are back on the stage.

        I will say two things - firstly, Crapbot are beatable. They must be - I beat them. Secondly, Muck Hall are the absolute lowest of the low. Literally, the so-called "industry"'s worst bottom-feeders.

        Why have you not asked for a CCA on this one? It does provide a degree of protection while the enemy remains in default of the request.

          To be honest they just disappeared whilst I had my head in the sand and marked my file "gone away" - they resurfaced a few months ago and with this going SB in Marchish next year I have been holding off to buy myself more time.... sort of keeping my head down as all correspondence has been very non threatening and more in the vein of are you still there???? I will CCA as soon as I feel things are moving up a step as I don't want to end up in court or worse a SD and missing the chance to fight UE but I think timing is crucial to keep this one going..... I will of course take any advice from here word for word... so if you all think its time to stick my head up and CCA them then I will get it off first thing on Saturday morning....

            Well, personally, I would send for the CCA now. While they are in default of the request, they cannot enforce. There is every chance that six months would expire before they would be able to come up with anything.

            Of course, this is just my opinion.

            I'm typing this on my cell phone while drinking a pint of real ale in my favourite East End real ale pub, before getting the train home from my birthday trip, so forgive me if the odd typo creeps in.

              You could go either way with this Jane. As they are still non threatening If it was me I'd try and tough it out a bit longer, at least until the new dca makes first contact, to play for time.
              I'd see what they have to say and take it from there.

                There are risks either way. If you send for the CCA, the risk is that they pull an enforceable one out of the hat before the SB date passes. If you don't, the risk is that Crapbot pull the alleged debt back and issue court papers because they realise they are running out of time. You'd then have no s. 78 (assuming this is a credit card) protection.

                Bizarrely, while there is a theoretical requirement for a Notice of Assignment to be sent when an alleged debt is assigned, there is no requirement for any notification to be given when the same alleged debt is passed back to the account holder. This is a far more serious occurrence, as the account holder is in a position to litigate.

                So, here, there would be a possibility that (the utterly useless) Mucky Hall would return this, and you could receive court papers without even knowing that they were off the scene.

                I don't think there is a definitive answer to this one either way, unless you are psychic. The question is, though, if you don't send for the CCA, what do you send? Virtually all of the AAD templates are follow-ups to having submitted a CCA request, and if you take an ignoring position, I think that you increase both the risk of the case going to court, and of annoying the hell out of the judge should it get there.

                In my own case, Crapbot took over a year to locate an agreement which was relatively recent and should have been easily found. If this present case was mine, I would be sending the request very soon. While there may be no danger while the incompetent Muck Hall are on the scene, the big issue for me is that you would not be notified when they pass it back and the danger would be greatly heightened.

                  Hi Jane....

                  Things tend to end up with Mucky Hall as a last ditched attempt. I'm quite surprised that Cabot are using them to be honest, since they are more than capable of instructing solicitors and issuing court papers themselves, which makes me wonder why they haven't.

                  Mucky Hall can't do much and are nothing to worry about..... all they're threatening is more letters and phone calls if they don't hear from you.

                    When you have no paperwork, and the statute barring date is drawing nigh, the best you can do is employ some ultra-aggressive telephone bullies to try to wear the victim down and obtain a pressure payment, thereby wiping out five and a half years of non-activity. Ouch!

                    Of course, it does rather fall flat if you're dealing with enlightened AAD members, who are not exactly prone to engaging these vermin by voice.

                            Just working out SB dates and dates defaults drop off - Although I believe my Cabot debt goes SB in Jan 2015 the default doesn't fall off until August next year. Aktiv becomes SB in May 2015 but default is 6 years end December 2014 and my Marlin card is SB in Jan 15 and the default is 6 years at the end January 15.... all would have become SB much earlier but I dabbled about and paid the odd £5 here and there when I was brave enough to open letters many years ago...
