    I'm no expert but offering a 50% discount suggests to me they aren't that confident with what they've got.

        i'm with Mrs D, They have to send a statement every year, so they just put the voucher at the bottom in the hope you may take them up on their generous offer,

        their way of thinking is " oh they have this account, we can't do anything as there is no compliant CCA so, put a voucher at the bottom and lets see if they bite and offer us some money coz they may not realise that they don't have to pay us."

          Hi all, I’ve got a couple of days off so thought I would update my diary.
          J&P the solicitors dealing with my CCJ who kept on writing and saying I was not up to date have written back to confirm I am and that they have sent the letters in error! Glad I wrote to them and sorted it now as although I knew I was up to date is was a worry what they would do next.
          16.05.14 – letter from Cabot Financial – these people marked me as gone away and didn’t get in touch for over a year – they seem to be sending a letter every couple of weeks now – this one is their offer to me – they understand I might be in difficulties and they want to help! They end saying they do need to receive payments and that if I don’t make any I might affect my credit rating – but no threats as such.
          I have never sent a CCA request to these people and I am thinking perhaps I ignore this one too? Any advice gratefully received – it should be SB later this year .

            Hi TJ

            This appears to have been received 4 days after their last letter - I'm wondering what was the interval between the dates on the letters. If there are no threats in the letter, I think that I would probably continue to ignore for the time being. Someone else might have a better idea.

              Thanks Still Waving - I am having trouble posting on the site so its not so clear - I only received it on Monday so it must have been sat in the system for some time! They do seem to be quite keen to get a response but I haven't spoken to anyone on this account for probably 5 years...... it was a Barclaycard many moons ago and has been passed around during the time I had my head stuck in the sand. Just slightly concerned I have never CCA'd them and I don't want them to jump straight to court and not give me a chance to..... I think I will ignore see what else turns up. Jane x

                My thinking is that I would send them a cca request. This would help to count down the time to SB as they would have to get it from the OC who probably won't have it. Even if they have, it may take them some time to rummage around to locate it. They can't take legal action while they're in default of a cca request.

                  And even if they do come up with some rubbish recon they'll be getting a Missing Prescribed Terms letter after that to help pass the time When is it due to go SB Jane?

                    That was why I suggested sending a CCA request...whatever they eventually come back with Jane can send missing PTs, refusal to accept UE status etc...and it will be October before we know it

                      Grrr just pulled the whole file out and I don't have much on this card as I completely ignored them for the last couple of years but for some stupid reason I seem to have paid them £5 in January 2009 - it appears to be a one off payment I suspect I felt under pressure from them as I was about to give birth (George was born Feb 2009) So it wont actually be SB until Feb 2015! I think I will CCA them this week..... Jane x

Unfortunately I don’t have that sort of moneyand anyway they still haven’t sent all the agreement over; they did state thatthe account was on hold until they found all the pages but I suppose they stillneed to send a statement? I am going toignore unless anyone tells me otherwise…?

                        06.06.2014 - Received a letter from Aktiv Kapital offering me another opportunity to use the £6678 voucher to settle my account...... filed.

                            Well I didn't CCA them and got back from a break away to a letter dated 21/07 Saying I must contact them..... then they explain First Steps - getting in touch and arranging a payment plan however small, then the last paragraph tells me if I don't get in touch my credit file might be affected!

                            Very un threatening but do I risk ignoring till the next letter and closer to Feb 2015 or do I CCA now???? What do you think?
