    Thanks everyone seems they are trying to get me to fill in their gaps I shall just ignore this request I think.

    Its nearly a year since I found you wonderful people when I was at my lowest point ever, what a difference 12 months bring this Christmas I've looked forward to the post coming through the door, and I sleep much easier in my bed only 8 months to go to 6 years on most of my debt so I'm just going to sit tight

    Love to you all and a very merry Christmas from me.

        Well today I have received a letter out of the blue from Cabot. This was marked on my credit file as gone away so I have just ignored it so far and haven't heard from anyone for over 12 months! They are asking me to set up a payment plan with them, they say they have been trying to contact me, they haven't. There is absolutely no threats in their letter, in fact all they say is if I don't set up a payment plan that this account may be showing on my credit file and may affect my ability to get credit elsewhere.

        What would you do? As there is no threat would you just ignore it or should I now CCA them?

              Thank you, was just slightly worried as I haven't ever sent for a CCA but it was a very tame letter and my gut feel was to ignore for the time being. This will become SB in October 2014 so will just sit back and wait

                Received a letter today from Judge & Priestley about my CCJ with 1st Credit re an AA loan - the covering letter says that they attach by way of service upon you order granted 19th December 2013 substituting the claimant in this matter.

                This is for information purposes only and you are not required to respond.

                Attached is an A4 sheet with a Northampton County Court heading saying that this was before Deputy District Judge Rowley on the 13th December 2013

                and the order is

                1. The Claimant's name be substituted to 1st Credit (Finance) Limited, on the basis that the substituted claimant is the true claimant.

                2. The substitution is made without the need for re-service of the Claim Form. Judge and Priestley solicitors serve a copy of the draft order upon each defendant specified in the schedule to the application of 1st Credit (Finance) Limited.

                3. There be no order as to costs.

                4. This order has been made without a hearing under the Courts case management powers contained in CPR part 3.

                Note: This order has been made without a hearing under the Courts case management powers contained in the Civil Procedure rules Part 3.
                You may within 7 days of the service of this order, apply to set aside or vary the order under part 23 Rule 10.
                You must file with the Court, and serve on the other parties an application that sets out you reasons for the objection. A fee is payable upon filing the application.

                I am unsure what this means to me? I got the CCJ before I found this amazing site and to be honest have just been paying the £10 a month, although in hindsight I wish I had known some of what I know now then if you know what I mean.

                Should I do anything?

                  Do not have an answer for you Jane but my post may bump this up for you as am interested in the answer.

                  Seems from what little understanding I have 1st Credit are doing what they should be doing if they want to benifit from the protection of the CCJ.

                  So many DCA's dont do this and debtors are left in crazy situations like we are.

                  CCJ and CO are in MBNA's name so they have a charge on the house. But we owe them nothing. The debt was sold and the owner is Marlin who have diddly squat protection of anything. Just a NOA. We pay the solicitor who worked on behalf of MBNA.

                  One has to presume there is a cost implication to the DCA for changing the names over hence why they dont do it. But if you kicked off about it then sure as hell the court would allow them to substitute themselves and probably award costs against the hapless consumer.

                  Really sucks when you have a charge on your home to someone you owe no money to because they are so greedy they write it off against tax and sell it on.

                  As to if you should do anyhing. One suspects not but am sure someone will advise you better.

                      Yes I agree Elsa. They may have had a slight change in name so just bringing the paperwork up to date. No need to respond.

                      Did first credit gain the CCJ, or was it in another name.

                          Posted this in the one year on thread but thought I would put it in here too in case any newby reads my diary and will hopefully give them the strength to start the process.

                          Well 1 year ago this week I stumbled across this amazing place when I was scared and in the proceeding week probably at the lowest I have ever been in my life (and that's saying something as I have survived a lot!) Dragging me out of my desperation Niddy and the very lovely Elsa (and others to numerous to mention) guided me through the horrendous situation of being served a statutory demand. Thankfully this resulted in them settling for a F&F payment and I will never forget the relief when I realised I wasn't going to lose my boys home Since then I feel I'm back in control of my finances (I'm even beginning to save a little bit each month) - Most of my credit cards will become statute barred in November this year - one of my largest has been admitted to being unenforceable (£11,550 worth!) and I am working the paper trail with the remaining 3 with fingers and toes crossed I will reach that magical 6 year figure.

                          I still have a CCJ which I could kick myself over as I got this before I found you lovely people, but I will quietly wait for another 4 years on that one and then hopefully I can sort out our mortgage back onto a fixed rate (having to live with a variable rate at the moment).

                          For the 4 years I went it alone I was constantly in fear of cars pulling into the street, I had stopped inviting family or friends over for fear of some debt collector knocking the door and couldn't sleep for the worry - one year on I feel released from the pressure, I know if a letter turns up on the mat I only have to turn to here for a friendly ear and a lot of great advice, I no longer feel ashamed or alone. I really cannot thank everyone enough, I feel very inadequate as I'm not able to give advice to help people with their debt but I do try my best to cheer people up along the way if I can.

                          One year on and over £16,500 worth of debt gone and as I say praying I can get through to November without to much hassle......

                              Thanks for your post. Most of us on this site can empathise with you. I started with £34,000 fighting a small one, but believe that I have won most of them. We have all been conned by the system!

                                Only problem for a lot of us here was that we got here via cag!

                                There used to be great help over there but many defected and I couldn't understand where everyone went.

                                I got here eventually, it just took me a bit longer!

                                A very good post tastyjane and gives encouragement to others.
