      Hi Guys, just wondered if this needs a reply, I have sent off a CCA request for Lilly but this " To the Occupier " letter has arrived, they may have crossed in the post? many thanks Lillys Dad

              Now this situation makes much more sense. Lilly has got seven unsecured debts but they're all small amounts in the grand scheme of things. Some may even be UE. You've not reported any hassles with any of these creditors since August so hopefully all is well

              We'll tackle the mortgage and secured loan in a different way with the aim of getting them to *back off* while Lilly settles into her new home and enjoys her Christmas

                  Hi Plan B, You are correct, we have had no contact with the loans since August but have just received a letter from capitol Recoveries re the secured loan with GE Money that should have been paid off when the house was sold by NRAM. They state they will put it on hold for 30 days to give us chance to come up with an offer. They want an up to date I&E. Could you give me any suggestions how to respond, there was a suggested that we blag it as if UE was possible? , what you think, many thanks Lilly's dad

                    Hi again, we have now received a letter from DMS on behalf of capital recoveries who were acting for GE Money asking us to contact with a current financial circumstance situation. When NRAM repossessed Lillys house afdter her husband died they sold for less than the estate agent valued it at and left LIlly with a £12,389.86 debt that was secured on the house. Any suggestions on what to do next would be really appreciated, thanks Lillys Dad

                      Since this was a secured loan it's possible for them to chase Lilly for up to 12 years but most give up much sooner. Having said that it might we worth looking at the G E Money loan agreement to see if the contract was drafted correctly. There are news stories every day where the validity of some secured loan agreements are being questioned. Have you got the original agreement to send to Niddy for a lookover?

                      Was this loan sold to her by a broker (it must have been since G E Money didn't generally deal direct with the public)? Was it in joint names with her late husband? It may we worth looking at how the loan was taken out. Blemain are losing in court (settling at the door) with irresponsible lending-type issues on secured loans. Dig out the paperwork.

                      It's a bit silly of them to ask for her current circumstances after her home was repossessed. You would think they'd realize that if she had any money she wouldn't have been repossessed Unless anyone disagrees I would send them a one-liner telling the truth. She's been widowed, repossessed and hasn't got a bean. If she starts to give them hope they'll never give up.

                      There's no point in rambling on to G E Money about NRAM's conduct of the sale because that's not their fault. It's like saying to a creditor "sorry I can't pay you because I got mugged".

                      I hope Lilly is doing ok. Give her a from me.

                        Hi Plan B, thanks for the post. Lilly is doing OK, thanks for asking. She is seeing a councilor at the moment and is not at work but we hope that she gets back on her feet soon. The loan was done through a broker apparently and I have got for the agreement and it does have both names on it. I will send the agreement to Niddy and also send a short letter to DMS as you suggest, once again many thanks Lillys dad

                          Lilly has been through a lot. There is no rush for her to get back to work. Make sure that G. E. Money are told she has no income except benefits and a widow's pension (I presume) because they may not be instantly aware of her personal circumstances. They will see it's a joint loan but may think it's a divorce situation not the tragic loss of her husband. I'd be tempted to write direct to Mark Murray who overseas the Hardship Solutions Team. He doesn't look all bad in his photo:

                            ^^^^ which begs the question, why didn't that broker recommend life insurance for Lilly's husband as part of the package because he should have done knowing that his client was married with two young children

It says Lilly's late husband cancelled the insurance on the mortgage but she doesn't mention whether there was any insurance on the secured loan. Could there have been? I think the circumstances surrounding that cancellation of the insurance on the first mortgage may be relevant. Was the mortgage in arrears at the time? Was the lender putting Lilly's late husband under financial pressure so he cancelled a vital policy in order to comply with their demands?

                              If Lilly doesn't remember signing the G E Money secured loan is it possible she didn't? Do you have the paperwork?

                              I'm looking for things which could help her negotiate with the two lenders to get the balance(s) written off. Or any irregularities in the way the loans were set up and/or conducted which would enable her to refer a complaint to the FOS to buy time if nothing else.

                                Hi Plan B, Lillys late husband used to sigh her name all the time without her knowledge on joint accounts and agreements etc and was very good at it, we do have the paperwork and the signature looks good but Lilly has no recollection of signing. She remembers a guy coming to the house and leaving paperwork but that's all. I have checked and there was no up to date insurance on the loan with GE. The mortgage was in arrears as he had cancelled the direct debit a few months earlier before he died. A lot of things have come to light since his death and it appears very uncertain as to what he was up to, (extra marital) this is what has caused Lilly to go into depression and need counseling. Lilly has signed an authorization for me to deal with all her financial situation as we don't want her to deteriorate any further. NRAM have put everyone under pressure, even told her to stop giving the children any pocket money. They really are the pitts, hope to speak soon, regards Lillys dad.
