    Yes, I know exactly what you mean. It can be very frustrating, that said I don't really worry too much about the letters I receive anymore, I try to look upon it as though I now get to frustrate and cost them money... that they are.

      Received response to CCA request. Letter dated 22nd March. (This date is outwith the 12+2).

      21st May received letter from Mercers - Default notice.
      21/05/12 - Mercers. DEFAULT NOTICE SERVED UNDER SECTION 87 (1) OF THE CONSUMER CREDIT ACT 1974.

      22/06/12 - Mercers. Immediate action needed. A DEBT COLLECTOR MAY CALL AT YOUR HOME TO OBTAIN FULL REPAYMENT.

      19/07/12 - Mercers. Written letters to you, you have not responded. Passing debt to Calder Financial, a representative may call at your address.

      31/07/12 - Resolvecall. Barclaycard Account. Acting on behalf of Mercers. Should you fail to contact Mercers may lead to personal visit to your home and we may commence legal action.


      06/08/12 sent Our Templates | Unenforceability Templates | Threat by Creditor - To Commence Litigation

      9/08/12 - Letter from Resolvecall, account returned to Barclaycard.


      Hi All,

      Received a letter from Barclaycard, In brief:

      We've identified that we have been reporting inaccurate info about your account to Credit Reference Agencies, we apologise for this error and we are correcting it. Our reporting should have shown that your account had been defaulted.

      Your account will be reported as defaulted from xx September 2012 with a balance of £xxxxx. We must give you notice of our intention to report your account. You have 28 days to make a repayment proposal. Formal demand enclosed with this letter.

      We previously issued default notice informing you that if you are unable to pay off outstanding balance we'll issue a formal demand for payment. We'll update credit refrence agencies within 28 days of the date of this letter. If you unable to reach a payment agreement will report as defaulted and legal proceedings could be taken against you. Call us.

      So, is this anything to worry about, or is there anything I can do hear? I stopped paying this well before Septeember 2012.

        They are supposed to register a default within 6 months of the date of the last payment.

              personally i would wait until you're firmly over the SB line, then you can argue about default dates, remember you've only got 5 years to go not 6

                • Hi All,

                  Long time no post. Hope everyone is well and doing okay...

                  Last month the final default dropped off my credit file - Happy days I thought to myself.

                  And then, out of the blue I received a letter from Shoosmiths, acting on behalf of their client Britannica/Arrow - the original loan was with EGG. A history of the account is below. I have to respond by December 7th or they will write to me again, finally they say this, "If planning to seek advice it is essential you let us know as in the absence of your contact legal action may commence". The amount they are asking for is £5000 less than the original loan and they are offering me a discounted settlement figure, if I pay it they will mark my credit file as "partially settled" and this will remain for six years.

                  I thought that this was now statute barred as the default date was August 2009 and I live in Scotland? Any advice on how to respond would be greatly appreciated.

                  04/042012. Received letter in response to above.
                  17/04/2012. Telephone call from RMA Resolve. Ignored.
                  23/04/12. Letter from RMA Resolve. Received 10 days after the date on their letter.
                  24/04/2012. 2nd letter from RMA Resolve. Received 7 days after the date on their letter.
                  16/03/12. Received a "recon" against an online agreement for one which was completed over the phone.
                  Niddy advised to send this. Our Templates | Unenforceability Templates | CCA Query - Forged Document Received
                  31/10/12. Letter from Solicitors acting on behalf of Britannica Recoveries.
                  03/11/12. Sent this. Account Sold whilst in Dispute
                  09/01/15. Received citation/writ/warrant from sheriff court on behalf of Britannica Recoveries S.A.R.L - Arrow.

                      I can't be certain, it was either January 2012 or February 2012.

                      • OK SB starts from when you last paid ANY money to the account, so if last payment Feb 2012 SB should be in scotland 5 years and one month from then so should of been SB march/ April 2017.

                        but if you had admitted to the debt in any time between then , for example if you wrote to them, or called them and used the words, My account, this could restart the SB clock,
                        Shoosmiths must have gotten the newby in the office to type it, if they can't see they are sending post to scotland,

                        I notice you received a warrant from the Sheriff court in 2015, what happened to that ?

                          Never admitted to the debt. Always followed Niddy's advice, as per previous post, sold in dispute etc. Sherrif Court - Just ignored it, no correspondence, no letters, nothing at all....

                                If legal proceedings started in 2015 then the Statute Barred clock would have stopped ticking at that point. So if your last payment was in 2012 the debt would not be SB because the writ was issued.

                                What happened to those legal proceedings? Were Shoosmiths solicitors instructed in that matter?
