    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

        well today i got a letter from fredrickson saying they are disappointed i haven't replied to bryan carters letter btw i did but perhaps its crossed sent it recorded delivery so i know they have had it.

        They are giving one final chance to make payment and they are willing to give me a full and final offer if i contact them within the next few days. otherwise they are going to reccomend to there client that solictors issue a claim against my address. I've not seen this type of letter before where they actually state that they will reccomend this.

        Theres nothing i can do if they do decide to do this you can't get blood out of stone and i'd only pay the minimum that i can afford even if they did get a ccj against.

            Just an update

            I can't believe its been nearly 4 months since my last post. I've been getting letters from both capquest and fredrickson but i've just been sending the letters as suggested by niddy and others. Not many letters but usually about 2 a month perhaps less. On the 9th of november i started to get calls on the mobile from AIC i didn't have a clue what it was about i didn't answer or reply to texts

            Today i received a letter from AIC saying they are now collecting on behalf of capital one and i need to make contact ASAP. This was dated the 9th but i didn't get it until today reading through posts i see this is AIC MO.

            previously dated the 28th october i got a letter from fredrickson saying that my account was on hold while they investigate my complaint (usual reply) several days later i got a letter from capital one saying that my query was being investigated and please allow 4 weeks or possible more for them to investigate. This is the usual standard letter that cap 1 send out and i'm expecting a reply soon saying they have complied with everything etc. But i haven't as yet.

            I've never had any involvement with AIC what type of DCA are they ? or is that a silly question lol

            I know i send them a no more calls only contact via letter and i withdraw consent to home visits letter

            but do i also send them an account in dispute letter and send them a copy of the capital one saying its been investigated letter as a way to shut them up for abit ?

            edit- the capital one letter saying they were investigating my query was dated the 8th november i started getting calls and texts from AIC on the 9th the letter received today is also dated 9th. So much for capital one investigating my claims lol

              It is my belief that AIC are quite as inept and rude as any other DCA.

              My account, arising from an RBS overdraft, was sent by the jerks at Triton to AIC who, even though I had paid the debt in full six days earlier, telephoned me to demand payment. I seem to recall the call centre monkey got quite angry when I told him that I would pay AIC nothing whatever and that he threatened that his employers would sue me. I now know that this could only have been done if the debt had been absolutely assigned to AIC - which I doubt it was.

              When I told him that the debt had been paid in full, he demanded that I submit proof of having done so. My reply was that I did not have to prove anything but, should I be sued, I would submit copies of the receipts in defence of the claim.

                  I wondered if niddy or someone else could advise as to my next course of action
                  I sent the account sold whilst in dispute letter to AIC along with a copy of the letter saying Capital one were investigating my claims as well as a no contact other than mail. Afew days later i got a rather detailed letter from capital one regarding my account basically they had supplied a valid CCA and thus that was the end of the story. Lots of quotes from previous court cases etc etc. They said that i could complain to the FOS but they thought it wouldn't be relevant and that my complaints would be better raised in court and they could decide on the validity.

                  Afew days later i got a letter from AIC saying i hadn't been in touch and they were giving me a further seven days. This was dated before capital ones letter.

                  Now what do i do now ? i know AIC recieved both letters because i sent them recorded delivery and they have accepted them. The phone calls and texts have stopped but they haven't replied to either of the letters.

                  Do AIC have to follow a process before submitting a CCJ claim to the court or can they just wait afew weeks and do it straight away ?

                  Before when fredrickson/capquest were involved they at least kept in touch and with each letter i sent they replied. With AIC its totally different and this is causing me to worry.

                          Not necessarily, no two accounts are the same - although elements of correspondence etc may make it appear that way, they never are - just use it as a light reference guide, it will not be the same - it rarely is

                            Just a quick update, AIC have sent a letter dated the 8th december ,why does it always take nearly a week from the date of the letter until i get it! saying i have not replied to there previous letter that's incorrect its just not the reply they wanted. They then go onto say i have 7 days from receipt of this letter which was today the 14th december to get in touch otherwise "AIC may recomment that our client initiates appropriate action against me" i don't know what recomment means but i think i should just wait to see what the next letter is that correct ?

                                Yes, pretty well - after all, nothing has changed, has it?

                                The reason for the delay is simply to make you panic.

                                Don't.

                                If the alleged debt was unenforceable with the previous numpties, this present rabble will have the same problems.
