      I'll send the letter tomorrow or thursday recorded delivery its to capital one isn't it.

      Could i ask one question you said it didn't have my signature but it is my signature at the bottom of the page its just thats all they have sent me no terms etc. is that why its unenforceable ?

      Its a very good forum i tend to pop in and browse to see how other people are getting on.

      Its an interesting forum thanks for creating it :-)

        The signature doesn't matter anyway, its because there are no prescribed terms on the form - you should have the prescribed terms on the signatory page or linked to them - nope, nothing present on yours so its :UE

        I thought the siggy was the banks, cos it is out of sync.... as I say it doesn't matter in any case.

          Hi Oldgrey, well I sent my letter off and it was delivered yesterday. It will be interesting to see what comes back. Good luck with the UE letter. Let us know what Cap1 say.

            thanks never in doubt i'll post the letter tomorrow i haven't recieved a letter from capital one or capquest since they sent the cca reply but its only been afew days.

            I'll update when they do

                  Hello again. I think I may have won round 1, I recieved a letter from capQuest today saying they have passed the account back to Cap1. Think its worth sending Capital 1 a CCA request just for the laugh?

                        I think I will send Cap1 a CCA request. I have had a CC with them for almost 8 years but don't think I ever signed anything as it was all done online.

                          Yea, just because it was done online doesn't mean anything - in fact it makes it harder for you to win, cos all online agreements are signed by a tick-in-the-box. Read this: ---> THE CONSUMER CREDIT ACT 1974 (ELECTRONIC AGREEMENTS) ORDER 2004

                            well today i've recieved two letters one from capquest saying its apparant they need to start litigation and naming a case handling supervisor and giving me till the 10th november to pay up they are offering me 20% off and i can pay it off in three months.

                            The other letter is from capital one itself saying they had recieved my letter * i sent a letter informing them that they hadnt sent the correct docnuments etc they thanked me for my letter and said they would investigate but it would take upto 4 weeks to doit it sometimes it can take longer than 4 weeks and if so they would contact me again. They also asked me to be patient while this was ongoing. it looks like a standard letter that can be sent out advoc.

                            hmmm so the two letters don't exactly match up although both were sent on the same day. I would assume that capquest don't know about the capital one letter which obviously still puts the account in dispute so they shouldn't be taking this further step by setting a 10th of november date etc.

                            I won't be sending any reply until early next week if you want i can send both letters for you to look at.
