      Re: capquest

Niddy has been a fantastic help to me all year, and after following all the steps regarding Capital One and Capquest, the last I heard from them was they would no longer be chasing up the matter and I have not heard from them since November...

          Re: capquest

Hi all, just to ditto what some of the other posters have said. My particular project is Crapquest. If it hadn't have been for the information I found on Niddy's old thread (next door) I would have been paying off an UE for the next XXX years. I probably would never have completed the payments as I am one of the more senior (well not that senior) members of the forum. With Niddy's help and advice CQ soon sent me a letter stating that in their opinion the debt they had purchased was unenforceable and they would no longer pursue me for it.

It didn't stop them passing it on, still armed with what I had learned it got stopped in it's tracks. I have recently seen more evidence of misleading and unfair practices that they use.

So if you hear from these people, post it up here. The more times they lose and get reported the sooner they will have to alter their practices or get out of the DCA business. (cant see that).

Keep the faith folks there is light at the end of the tunnel. I know I've been there.

          Regards to you all, Handy.

Well done on your success Handyman with this one.

Excellent post, it is just what many of us need to read occasionally to offer some us some inspiration in our own UE fight and good to see that the unscrupulous business practices of many DCA’s can be overcome.

              Re: capquest

              an update

i recieved a letter on the 18th January dated the 13th from Capquest informing me that i have until the 19th of january (today) to get in touch otherwise they will be sending my details to ScotCall who will make a visit to my home.

I assume i send no contact other than phone and revoke permission to come to my home letter thats in your library. ? should i send anything else ?

do they actually follow through with these threats i have family visiting for a couple of weeks from friday and would hate them to get involved.

i suppose i should be happy they haven't taken things further with litigation etc

                Re: capquest

I'm sure Niddy will be along soon, but if it helps...
Do they say "will" or "may" instruct/make a visit? These companies very often make blind threats! I've had tons of letters saying they "may instruct" xyz and "may call your property" or "may visit" - all stuff designed to make me think the bailiffs will be round in the morning. No one has turned up yet.
Niddy always advises us not to ring, to communicate with these people by letter.
There is a letter in the Unenforceability Templates section for Threat of Doorstep action. Unfortunately I haven't worked out to insert a link for it or I would!
                Hope this helps.
                Niddified and proud!

Fought and won the UE battle, thanks to Niddy and this forum...
SB since 2016. Now have my life back!

Hi oldgrey, I think many DCA's and creditors do this where they send letters giving you x amount of days to pay or contact them and back date letters. Is there a date stamp on the envelope? if so see what date it reads and I always staple these letters to the envelopes as proof of when they were posted and write a little note on the back of the envelope when you received it.

May not be of any relevance but you will slowly see that many letters are back dated to people and by the time they are received miraculously your out of time.......it don't take a Sherlock Holmes or a Watson to figure out their nasty little trick here LOL.

Hi Olgrey. this is what you need to send to them

                    http://forums.all-about-debt.co.uk/s...98&postcount=7

Its usually scare tactics in the hope that you will ring them......don't fall for it.

                      Re: capquest

and if they do turn up at the door tell em you're not in. and if you have family in at the time, tell em it was someone selling double glazing. They have no rights and you can just ask them to leave, so try not to worry, because mostly as others have said they don't turn up.

                            Re: capquest

                            Thanks for the response

                            the letter says

please be advised that we are now in the process of making arrnagements for our doorstop recovery agents scotcall limited to visit you due to non payment if a repsonse is not recieved by the 19th january an agent will be despatched and will call at the above adress betweeb hrs etc

the doorstep collector is instructed to collect the full amount due and compile a report to assist in any possible further action.

then it goes on to say that to avoid this happening i should make contact and they offer me a discount on the amount owed etc

all seems very direct so i expect they will call

i'm tempted to phone scotcall and explain that the account is in dispute and i've issued a letter only contact request.

I got a letter from resolvecall which is part of scotcall last year april time i believe about my accouint before it was deafulted. so i have a contact number for them i just wouldn't have a ref number to quote.

                            edit

just printed the no contact letter above thanks evenlessdopey will send it today.

as i recall i've already sent them one or even more before so..... and they acknowledgedly it by sending me a thank you letter lol

                            edit number 2

i do send all my letters to capquet recorded delivery and i've got reciepts and replies all filed away (shoebox) lol

no Oldgrey, do not phone em, that's exactly what they want you to do so that they can bully you into paying something. These guys have no power and you can just tell em to bugger off and IF they do turn up, that's is exactly what you do. You have asked them to deal with this in writing, you have to make them do this, so no phoning and no talking on the doorstep, (but odds are they won't turn up). They want you to be worried and feel scared, don't let them win! anyway i think Scotcall are based in Glasgow, do you honestly think they are going to send someone from Glasgow????
