      I won't be sending any reply until early next week if you want i can send both letters for you to look at.

      Regards to the email, yep got it first time. If I never i'd post on your thread that I never received one

      However, regards to CrapQuest you ought to send the following back to them: ---> viewtopic.php?p=2318#p2318 enclosing a copy of the Crappy1 letter. As Crappy1 are looking into things for you CrapQuest cannot take any action (and they know this as well).

      Have they sent the agreement yet - I cannot remember checking an agreement for this?

        Don't apologise your helping us so no worries on that score hope you were busy having fun rather than work.

        Yes they have sent back the cca but it was only my signiture without the terms i'll send it again later today

        I replied to capital one saying that wasn't the true copy etc and then they repsonded with the letter dated 28th october saying they would investigate and get back to me. Its a standard letter so in due course captial one will come back saying they have sent it and they have satisfied the request.

        But since capital one are still looking into it capquest can't go forward so they shouldn't have sent out the letter. But its only a stalling game

        I sent capquest a letter saying it was in dispute along with a copy of the capital one letter.

          Ok, no need to resend me the agreement - I kinda remember now anyway, thanks. Basically just send off what I previously advised, that will sort this side of things temporarily....

            I got my final response from capital one saying they have now fully complied with my request. its legal etc etc

            No letter by capquest but i assume that will follow shortly.

            I went back and read the stuff they sent

            The signiture is mine but i thought i'd been with capital one for much longer than just 2004. which is the date of the form they sent. Would a sars be of any help i know its ten pounds but what information would they send or should i have done this at the start of this process ?

              Don't worry - no need for a SAR, it'll be unenforceable as long as you stand up and fight them - keep us updated, don't stress and do not apply for SAR.

                    capquest have sent me a letter today bascially the same as before saying if i don't make arrnagements to pay by the 3rd decmeber that it will be passed to the litigation department. they have offered me 20% off.

                    i thought it had gone quiet recently with capquest lol

                      Just ignore them - see what they send back next time! If they send to litigation - fine!
