      Hi Undercover Elsa, I've managed to upload the letter from bank there's a couple of things that I don't agree with.
      second part of letter para1. Nothing was mentioned about amalgamating my loan with my current account, my balance was nil, they then debited the account with the loan payment of £253.01 plus £4.78 debit interest plus £10 service charge plus £73.50 daily excess charge making my account £341.29 overdrawn. Then 12 July debited £253.01 again but on the 13 July done an in fund adjustment for this amount but still leaving me overdrawn. Then on 14 July they done another in funds adjustment for £9476.65 now making me £9817.94 overdrawn.
      i NEVER sent in a I&E form and a DMP was not mentioned . They were fully aware of my circumstances and that I was on disability benefits as this was paid directly into the bank, I did speak to them on the phone and I was told to pay a token payment of £1 which I did it was the reviewed every six months
      In the decision part of letter the default was registered in 2000/1. (Have date somewhere) they then added it again in 2009 when the account was handed to PHEONIX I finally got it removed in Jan2011 only to be put back on in 2013 by CABOT. This has now been removed.
      Now I've got CABOT hassling me

          Whether or not they can come up with the fine details, the fact is that they did amalgamate it and unless you were a CCA expert when it happened how would you know it was wrong to do so? You've only just taken advice on this and been told it's wrong, so your complaint is still valid as far as I'm aware..being from when you first became aware it was a problem.
          Let's see what Niddy says when he gets back. Maybe ATW too to look at the legal aspect of the amalgamation specifically in the relevant year.

          Anyone else notice that they put "£250 in full and financial settlement of your complaint" ? Eejits!

          I'd hold off cashing it till you see what Niddy says, just in case your acceptance by cashing is a sneaky get out of jail free card for them.

            Good morning Elsa and thank you for your reply. Unfortunately I've cashed the cheque, I thought it was for the inconvenience of 3 default given on the one account from 2000 to 2013 It was nearly Christmas and it came as a big help, done the wrong thing again

                  Update, after sending CABOT a failed to comply with my CCA requests.
                  Letter today, we've tried to contact you on numerous occasions to discuss account.
                  Yes bloody phone never stops ringing, their number. Don't answer.
                  Have told them more than once everything in writing only
                  Letter goes on to say PAY UP. If I don't contact them immediately to make arrangements they will continue to try and contact me and my account will be passed to next stage for collection.

                  I'll just Ignore for now and see what happens

                        Another letter yesterday from CABOT, (had a good laugh.). It says,
                        We believe we understand debt and want to share our thoughts with you.
                        We will ensure your priority expenditure is up to date and arrange an affordable and fair repayment plan.
                        We own this account and are prepared to give a substantial reduction of the balance in order to help you. Call us now and make arrangements, if you can't make a one off payment we can spread over the next couple of months.
                        Thanks CABOT but I'll stick to my arrangement. ZILCH

                            Another letter today from CABOT. In brief it states,
                            Despite repeated attempts, I've failed to repay my debt. If I don't PAY UP or contact them within 30 days recovery action will be taken
                            This will result in my account being passed on to another company, who will contact me.

                            As CABOT still has not complied to my CCA request, will I just ignore this and see what happens?

                              Yes, I would, they aren't actually threatening anything! Expect to hear from FIRE next, another of their incarnations!
