    ID enquire on what basis they would bring proceedings for Quantum given that Quantum are neither the contracting party or a whom rights have been assigned to, so how could they threaten to take such action for quantum.

    Shocking attempt to mislead a consumer, contrary to the Law Society practice note on Litigants in Person

    BTW, id treat that letter as a letter of claim, once of course it is established that they (quantum) have a right to bring proceedings, which they dont!"!

      Mate first it's going to be along the lines of "due to your extremely severe breach of data protection, I strongly urge you to consider writing the entire balance off..."

        when that happened to us, we wrote to the person whose data had been provided, and they made a complaint too!!

          well here's the thing, if they don't bite with the offer to write-off the debt, we will then do that lol. But hopeful they take the offer, we'll see

            Actually scrap that - I can't do it on this one, it's a £21k debt - can I forward the email you sent me with the 18 page attachment to Paul to check over please?

            I would rather he checked this to be honest and I also think you'd be well served looking to chat to him.... £21k is a game changer. I will PM you....

                Sorry internet just went off! I have replied Niddy and of course am happy for Paul to help please.

                Hi Paul, Any idea of a SD puts me in panic mode so OH would be even worse!

                There's been another couple of letters which I didn't have when I emailed the information to Niddy, if you need to see them, I can send them over to you when I'm in work tomorrow.

                One was from Cabot advising that they were passing the account to Quantum and enclosed a letter from Quantum, those are dated 15/5 and then another letter from WH dated 20/5 saying Quantum has instructed them to recover the debt and will be obtaining a copy of the credit file to help them understand what assets, current employment and ability to repay.

                They will then assess things etc.

                    Yes we are Niddy and have equity but just in the process of dealing with our lenders in order to change from interest only to repayment.

                    We're one of those 'ticking timebombs'who were sold endowments which turned sour!

                    I'll take the letters into work to scan and email over to Paul.

                      File now prepared for scanning and sending over to Paul.

                      Having spent a few hours last night going through it all and doing a timeline, it really opens your eyes to how these companies behave!

                      The threats of what they were going to do, over nearly three years and without producing any sign of an agreement, recon or not. And then sending one in someone else's name!

                      Just one question please, whilst I was over the other 'side', it was always stressed to keep all the envelopes (which I have), I of course realise the importance of the envelope the NOD comes in but what about the rest?

                      It would have taken me about 5 minutes to scan just the letters but as I have the envelope attached, it will take an age to remove the staples before I can scan the letter. (I'm not planning on sending Paul the envelopes).

                            I have exchanged a few emails with Paul, I drafted a letter which he advised needed more information as far as pre action protocols are concerned and he has added a lot more to it for me.

                            I just had one query which I've asked him to clarify for me regarding whether or not to point out where they have gone wrong with the documentation they have sent.

                            Once that's done I'll get the letter sent to Wright Hassall.

                              You wouldn't normally tell them where they've gone wrong - that's like showing your opponent at poker your hand in-play

                                That's what I thought Niddy, hence querying it with Paul but he's not come back to me yet,I expect he's very busy.

                                I really appreciate him taking the time to help with this, it is a worry that WH are quite aggressive apparently.
