      Update, received written notice from FOS today, saying they will be trying to assign my compliant to an investigator (or whatever they call em)

      But also said, they are dealing with so many PPI claims it could take up to 12 months for a decision. GRRRR

      Will contact again after 6 months if not resolved beforehand.

      Bloody bastards, exactly what HSBC rely on.

        Update time. Today received a letter from the FOS.

        They are.....upholding our complant

        They have given HSBC till 14th June to supply them with a valid reason why they should not pay the PPI back.

        Well HSBC can not supply them anything other than what they stated in their final decision letter which FOS has had, so its looking 99% likely they will be paying out very soon

        FOS states we will hear from them again in 8 weeks.

        So as its taken this long, im guessing there will be more interest added to the reclaim?

                Hey guys, little update.

                FOS have replied again, this time enclosing a copy of HSBC's response to the claim.

                HSBC have basically said, that at the time my mother "would have" been informed of her right to cancel, "would have" had a leaflet explaining her rights, and "would have" had 30 days to cancel the PPI.

                They also say, that as the loan was taken out 14 years ago, my mothers recollection of events may be some what faded and its on that basis that they feel the FOS should not rule in her favour.

                FOS have said they may need to review the claim again, and will get back to us in due course.


                Really winds me up, their whole letter is based on assumption, yet my mothers statement is being regarded as a faded memory rather than fact.

                I really hope the FOS uphold our complaint still.

                Quick question, if the FOS do decide to no longer uphold our claim, is there a right of appeal?

                    I did wonder, part of their letters sentence read "I/WE....."

                    Which was a clear indication that it was a template generated letter lol

                          Reading your thread think you are at the adjudicator stage still. Believe you both have the right to refer it to an Ombudsman but you do have first stage to you at the moment.

                          The pile of poo HSBC have come back with makes my blood boil.

                          The scandal is about the mis-selling of PPI not about the what did the client do after the policy was sold to the client scandal. If what they say is true then everybody had the right to cancel so nobody should be compensated.

                          Its quite right to bar a claim if when you took it then its was good for you but say you went self employed later so it wouldnt pay out. Perfectly reasonable, client should have checked the PPI was still valid.

                          If at the moment in time that your mum was discussing the loan and anything else that was to do with the loan she was mis-led in anyway then that is what the scandal is about. We all have had and still do have memories of the hard sell on these things. The public isnt imagining this.

                          What she did after that meeting/interview dont matter. Does if she had fish and chips or haute cuisine matter to what happened at that meeting.

                          I dont think so and so does she could cancel ya de yah de yah. What happens if at that meeting the salesman indicated having PPI was a requirement of the loan.

                          Would she have then gone home and thought hmmm lets cancel the PPI. No because the salesman mis-sold the PPI which is what the scandal is about.

                            Exactly Ken, you understand exactly where im coming from and what my argument to the FOS was initially.

                            My points were that the bank manager lead my mother to believe it was a requirement for acceptance of the loan, and had she been advised correctly, she wouldnt have wanted it or needed it.

                            The FOS questionaire askes what savings would you have had to cover being out of work and she told me it would have been 3 to 6 months worth, so again, PPI would not have been needed.

                            HSBC's argument from the very start has been should haves and would haves, where as my mothers argument to FOS was more, this happend, and that happend, and was wrong based on what we all know to be miss selling.

                            I cant see how fact can be over rulled by assumption, and i just hope whoever is at the FOS is not an idiot and is impartial and can see exactly what you can.

                            On a personal level, i know my mother, she would not have paid for PPI unless she thought she had no choice to, shes never had it for anything else ever, and actually, shes always been under the assumption that PPI doesnt pay out for self employed people, even though some actually do, the fact she thought they dont, proves she would never have wanted it in the first place.

                              That's all very well and good, but would & should is not the same as did. Your mother was not sent any additional leaflets nor was she sent anything outlining that she had 30 days to cancel as it is known that HSBC loan agreements were on several printed sheets with all leaflets following later through the post, and nothing ever came regards PPi - put the bank to strict proof on that point. They will fail.

                              At that I would suggest to the FOS that a new complaint will be forthcoming based on these insulting remarks. Point out that your mother is of sound mind and put the bank to strict proof of the reverse, ask them for a written account of events from the salesperson at the time, who was the ONLY other person present with your mother - funny then how your mother remembers everything about that day yet the bank are relying on if's and maybe's - fact v fiction.

                              FOS have said they may need to review the claim again, and will get back to us in due course.

                                we wil;l be awaitoingthe bog standard response from HSBC as they keep sending O,H, forms to claim, well we have sent one back now, as 2 areas they mention may apply, even a claim was made, I got paid out 3 years ago after a claim was made, but was told would cover most events, but did not where I had to go back to work very very part time due to heart attack, employer refused to let me work back full+ time as before, then everything went down hill.
