    Personally I'd say that if you have any debts that are linked to the bank account your wages are paid into then I'd say yes and open a current account somewhere else that is not financially linked to any of your debts.

    This way they cannot exercise their 'right' of offset (although you can write to your bank and 'ringfence' your wages to ensure that important bills get paid first)

      ok cool... can they do that then? Just wade in and grab money? bar stewards!

      I didn't realise I could view the signature of the signed for.. so just got it and have saved a screen grab of it...

      Here it is.. from Low(life)ell ... Is it safe to put on here? Don't 'they' read these forums and try to link members to debts and then know what our next move will be?

        They cannot read much, we restrict visitrs to ten views then it blocks out - however it doesn't matter really cos you're doing things right, they won't be able to fix any errors by reading these boards, don't worry about that

        if it gets juicy we can move this thread into a protected section but right now it's not really necessary.

          Hmm OK I thought I only had one debt... BUT.. While looking for all the letters I have recieved regarding the HSPF debt (looks like at least 4 DCA's and 2 solicitors have been involved with this) I also came across a letter from LINK regarding my husbands MBNA card.

          Problem is this.... MBNA card sold the debt to Link Finanvial Outsourcing on 21st march 2013... I ignored the letter and have been making random payments to MBNA sometimes a hundred, sometimes £40 etc etc some months nothing.

          Have I done wrong.. I didn't understand any of this until I joined here... what should I do with regards to MBNA.. where are my random payments going if they sold the debt and "terminated" the CC agreement?

          Last statement from MBNA is dated 02/01/13... letter from them terminating account 07/02/13...letter from Link dated 05/04/13 saying they bought debt 21/03/13

          Holy carp.. so that's another £2,771 to add to my disgusting debt...

            I'm not sure where your payments have gone...they should have been credited to your account. When was the MBNA card taken out? Are you thinking of going for UE on this (I would). In that case it wouldn't really matter where your payments have gone. If you're going to go for UE, send a CCA Request to Link.

            By the way, your debt is NOT disgusting...no debt is. If you're saying that because of the amount, there are some members with 10x that amount.

              I think I have to as there is no way we can afford the repayments and besides.. it's been sold to Link.. we've not had any other letters from them so will wait to send the CCAR.

              I know :-( sorry... but to me it is disgusting ... I didn't intentionally take out these cards and loans with the intention to default them and thinking of £20k that I owe and am / will be hounded for gives me the willies... We both had really good jobs and a young family, we got cocky and took out CC's and a loan and now I have a loan I can't pay back, an MBNA card I can't pay back, a Tesco card I am paying back and making good progress on and TWO Barclaycards I am making minimum payments on each month... what a mess!! All down to the fact we thought we could handle it and when we lost the good jobs that we could reply on the CC's to get us through.. well we haven't come out the other side and are now in debt. pretty pants really...

                Sometimes life places in these awkward positions mate and its tough, but being in debt is not disgusting, or anything to be ashamed of. My circumstances changed somewhat and eventually my debts caught up with me.
                I had 15K of debt (and since joining AAD discovered only 5 is enforceable!) which i thought was massive although the truth of the matter is students are leaving University with more debt than that and no promise of a job.

                Chin up and stick around here - you are in good hands.

                    You need to read some of the unenforceable diaries to help you put everything in perspective. I started battling in 2003 and am still going! I made loads of errors as it was all pre AAD and gained a CCJ. Since finding AAD I have been helped to fight a court case and am still battling. Many of us have been in your situation and with much greater debts.
                    you will find that you will gain online friends and that there are posters who have knowledge and experience to help you.

                      Thank you so much... you'd think at 43 and the life I have had I'd not be such a wuss! Thing is I was brought up by parents who drummed into me.. "If you can't afford it, don't get it" if my Dad was alive he'd have gone spare the minute I even suggested the first CC!! Oh well.. one thing good has come out of this.. my children wouldn't dare get a loan or CC now knowing what 'can' happen...
                      So, positive head on.... I will get rid of MBNA and HSPF.. yes I will!

                        Hmm.. have been thinking... and also cringing as remember yet another debt.

                        I had a Barclays account before I met my husband and added him as joint account holder in 2001. We were sick of their chopping and changing of terms and charges etc etc so opened a Santander account together and planned to pay off the overdraft on the Barcalys one and close the account.

                        Well it's ridiculous, I pay each month but the interest is like £25-ish a month so it's one step fwd and 20 back!

                        In 2012 I asked them to freeze the account and stop charging interest as it was making it impossible to pay off the overdraft and they wrote back saying no. They then said that as I had made it clear I was in financial difficulties they had closed or revoked my use of the account and I could only pay in now, I couldn't bank with the account or use it at all, they wanted their money back.

                        I literally pay them here and there when I can afford it and from June to September didn't pay anything.

                        What should I do? Keep them the same as they are now or stop paying and wait for the DCA letter to arrive? If they had frozen the interest as I had asked then I would have paid them off by now the greedy mutts!

                        I owe £1,600 and have done since we stopped using the account.. it's impossible to pay it off!

                        EDITED: Just looked and it was February 2011 that I wrote to ALL of our cards and Barcalys bank to ask them to stop interest and they ALL wrote back saying no... bastards.

                          If it were me I'd send off a ----> CCA Request and stop paying....

                            LOL yes... just realised that one of the Barclaycards was originally a SkyCard that hubby took out in 2005... they swapped it to a Barclays Gold card in 2009 ... We've been paying them off and more than paid off what we owe but due to interest are still in debt to them... Should I feck them off too? Will it be UE or because they changed it to Barclay Gold in 2009 will it be a 'new' cycle of the contract?
