        Well it's got a bit more serious now...

        I received the attached today after returning from being away. I think they mean business so really need some advice on how to play this one if anyone can help.

        I am really worried about this now



        I have not been able to upload the letters as they are too big so I have linked to photobucket - I hope this is allowed and safe?

        As I say, any help would be appreciated.

            Would it be worth CCA'ing them first as they are a new company and this is the first correspondence?

            Is it past that stage now do you think?

                I would send the letter before action, they are threatening action. Everything else that they sent is simply to frighten you into paying them. Why not send LBA and a fresh CCA request to stop them in their tracks?

                  Did you actually send a CCA Request before beefy? Hard to read through this thread
                  As Deepie says, before doing anything could you give us a quick summary including original company, date taken out, approx amount owing, date last paid etc and if/when CCA sent and what was response.
                  Am I right in thinking you sent a F&F offer and didn't get a response? Hope they lost that!!!!

                    Good morning - Sorry I didn't get chance to get the information last night but I have it now.

                    It was originally a Vanquis credit card which started in 2007 and defaulted in February 2009. The default amount was £900 but that figure has now nearly doubled according to what Mortimer Clarke are saying. I sent a CCA request to Cabot last year and got the screen shot of the application, statements of account and terms and conditions which was enough for the to comply. I have never acknowledged the debt but did make a full and final offer around the same time along the lines of whilst I don't acknowledge the debt I want the matter resolved and and willing to pay xxx. They came back and wanted nearly the full amount so it sent no further.

                    All went quiet and Cabot then passed the debt to Marlin who have now instructed Mortimer Clarke.

                    Looking at the statements, payment was last made on 25/6/2008 and after that the only entries are interest, late payment charges, over limit charges and ROP payments which were totalling over £50 per month.

                    I am hoping I have just had a lightbulb moment - I was going by the default date as the SB date, but is it in fact the last actually payment date? If so, am I right in thinking this is SB on 25th of this month?

                    If so, what's the best course of action for me take? I can scan in further documents if needed.

                        Was that last payment the last contractual payment, ie had you been paying the full monthly payments up to that point Beefy? If so the SB clock starts ticking the day after the first missed payment.
                        Can you remember when in 2007 it was taken out? Pre or post April?

                          Hi,I had been paying the minimum payment up until I stopped. It was taken out post April 2007.

                            Sorry for the blunt previous reply - I was using my phone to post.

                            I had been paying sometimes more than the minimum payment but the last few payments were minimum payments. The card was taken out after April 2007 so I guess the best plan is to try and keep them from starting legal proceedings before the SB date which is so close now...

                            This is my only debt and I really don't want to fall foul at the 11th hour so to speak.

                                OK just read back, that means in your case 27th July.
                                Time to send another CCA Request and the LBA response as suggested earlier methinks.
