    No I haven't stopped paying yet........... this is the dilemma (especially as they have now accepted my payment arrangement).

    As I have just got almost 300 quid in a 'goodwill' gesture from HBOS for letting Albion harass me while a payment arrangement was in place, I am just a little reluctant to stop the payments for what is a relatively 'small' amount (in comparison to my overall debt).

    I did stop payments to Capital One though (over two years ago) as I have had no response to my CCA request, and the DCA they were using has been particularly aggressive so they got what they deserved.

    I think I may wait to see what response I get from Albion before I think about ceasing payments.

      It is also a little sad, as its an indication of the number of people who must be using CMC's, that creditors make this assumption, when consumers could be taking this actions themselves (up to a point).

      I may just see if I can get some NIDDY headed paper to send my next letter on, they may just get the message

        When are they going to learn? So HBOS/Albion have now farmed my account out to Wesc@t.

        This is despite:

        Payment arrangement accepted.
        In default of CCA request.
        No NOA

        Where do I start?!

        Looking forward to sending the response to this one! Complaint going to go back to HBOS als.

          So a response from my CCA request:

          They have been unable to provide a copy of the current t&c's

          They have been unable to provide a signed application form.

          All they have managed to produce is a generic financial products conditions document which includes things like current accounts, mortgages as well as credit cards.

          They go on to say:

          "Our procedure has always been to obtain our customers signature to an agreement containing the prescribed terms before entering into a credit card agreement. As such, we are confident that the agreement remains enforceable.

          The regulations define what is required of a 'copy'. Whilst regulation 3 provides 'every copy' of an executed agreement.... shall be a true copy'. Regulation 3(2)(b) provides that a copy can omit any signature box, signature or date of signature.

          In summary to comply with with section 78, the copy does not need to be a copy with the customers signature on it. We do not have to produce an actual copy of the document signed. The purpose of section 78 is to allow debtors access to their t&c's of their credit agreement and by providing the debtor with a true copy of the terms and conditions of the agreement we have complied with section 78.

          While we try to locate the full original agreement we will not be seeking to enforce the agreement. However, even if the agreement is unenforceable, the contract still have legal effect and is not void, the lender is merely prevented from seeking an enforcement order from the court."

          There is then a load of further guff advising me not to trust claims management companies.

          So a result!

          Am looking forward to writing my next snotty response to Wescot off the back of this beauty!

              Nope - I have cancelled the S/O. They can now whistle for this.

              The irony of this is that I was 'happy' paying the agreed amount, but they then farmed the account to their internal DCA who started the whole threat-o-gram funny business which got my back up.

              If they hadn't done this, I wouldn't have sent a CCA request, and they would have continued receiving payments.

              Instead, they subject me to harassment (so much for 'working with debtors') and now they have a UE agreement, which they will get nothing for.

              When are the stupid greedy bar-stewards going to learn?!

                  Also at risk of drawing the attention of the 'evil eye'............

                  Since the threats from Quickquid back in February I have heard nothing more from them, or the external DCA's that they were threatening me with.

                  I am sure this will not be the last I will hear on this one, but goes to show the standard '7 days' threat is a load of ballhooks.

                    Indeed they are!

                    What I have always objected to is the intimidation, threats and harassment towards customers who get into difficulty.

                    When its obvious that someone can't pay any more than they are, to what benefit is there to hound them mercilessly to the point of illness, or as we have seen, to the dreadful point where people contemplate taking their own life.

                    Its this behaviour thats beyond reason.

                      TWO emails from QQ since I posted this!

                      If I do not cough up the full balance immediately they are going to sell the account to an external DCA.

                      Well they said this back in February so I can't wait to see what lowlife they are going to pass it off to.

                        So despite being informed that I pay the balance in full, get another 2 emails today demanding payment in full, or monthly payments set at a sum I cannot afford.

                        They also demand my debit card details so that they can set up this payment plan and that no other payment method is acceptable.

                        Hmmmmmmmmmmm!

                        I will wait to see what DCA that they decide to farm this out to!

                          So update on Wescot and BoS CC:

                          Despite BoS not being able to fulfil my CCA request, and promising that they would not continue recovery action until they do, I have received a letter today from Wescots solicitors.

                          Apparently they are prepared to offer me a settlement at a significantly reduced rate, but only if I call them within the next 7 days.

                          Hmmmm I bet they want to accept anything right now!

                            I think I will need to nip this in the bud and refer them to their clients last letter. It'll be interesting to see then how much of an effort they will make to come up with an agreement........
