    Hi Elsa, yeah there is a comms log and there is several mentions of default notice on it but they all have question marks after it so I don't know if it was sent or not. Not sure what status was before just know it now says defaulted nov 2010

          Sadly, the default is likely to remain however any balance generated would not be owed as it's clearly Statute Barred in line with Limitation Act. So if you're getting shit then it's easy to get rid of the DCA by sending a SB template from here.

          The default, well that's weird - the fact is (regardless of the reasons) that you DID leave a trailing balance of £80 meaning the bank were well entitled to default you, however to be fair this should have been added within 6 months according to the ICO Guidelines on default issuance (see here)

          Sadly, that is only guidelines and not statute so the bank will simply say we left the account live instead of defaulting because it was helping the customer out - bollocks, granted, but still - that's what they tend to do.

          It's a bummer, but if you can confirm the following we can try and sort you a letter to send back:
          1. What is the actual default date on your credit file?
          2. When did you last pay anything (credit) into the bank account?
          3. On your credit file, what entries are showing in the account history fields (i.e. does it show loads of 6's then D's or what)? Ideally a screen print would be good

              Hi Niddy thanks for reply. The default date is 26/11/10 the last time any credit was paid into account was 17/05/05. On my credit report it just shows loads of 8's do you want me to shoe you this on my credit report?

                Ok so they have added lots of delinquent markers for years by the sounds of it....

                Can you screen print that whole entry and let me see it please as from that I can tell you the correct dates...

                        Thanks, ok so this is Experian meaning a status 8 is a default so as I can only see the last 2 years history and as these all show status 8's I can only agree that the default is correct.

                        Ideally I wanted to see the status symbols between the first missed payment and the first 8 being registered back in November 2010.

                          Ok no longer a member of experian but will try and get that for you. So what my next course of action or am I basically screwed here? Five years to default my account seems wrong to me but obviously I'm desperate not to have this on my credit report for another four years.

                            That report you sent was an experian report...... I don't need another, don't worry.

                            5yrs to default is bad, I think you could complain - bear with me, I'll sort something for you.

                              Thanks Niddy would be so grateful, I have no other problems with debt but this has screwed me and the mrs as she is being refused any credit now as she is financially linked to me. I know these credit report scores mean nothing now as I thought its fine I have a score of 997 ha wot a lot of crap as obv I can't get any credit.

                                I notice that there is a default registered with the credit agencies dated November 2010, however there was no activity on this account since the summer of 2005. Obviously, taking into account the ICO Guidelines of 2007 I wish to complain that you have unduly delayed adding the necessary default entry with the credit agencies.

                                There was no need for the 5 year delay, likewise I was unaware of this account even being open as last I knew it was closed back in May 2005; surely you'll have system notes to this effect? Therefore I am formally complaining about this unnecessary delay and formally request that you remove the default as entered on my credit report with a date of November 2010 as I categorically never had any accounts with you nor did I default especially not in 2010.

                                I have also raised a dispute with the credit agencies to the same effect and unless you act in accordance with current guidelines then I'll have no alternative but to formally complain to the ICO and OFT regards your behaviour.

                                Please send any proof that I have a live account with you, especially one that shows usage from 2005 to 2010 as failure to be able to prove any activity will leave you wide open for any court action I may take as a result of this behaviour and clear breach of rules and legislation.

                                I have since moved addresses. The address on account, from 2005 should be: ENTER YOUR ADDRESS AS AT 2005 and my current address is: ENTER CURRENT ADDRESS

                                Give them 14 days then report back, at this stage don't contact the CRA's - no need as they can only do what they are told byu the OC who at this stage, before seeing the complaint, will refuse removal anyway so it's a waste of time.

                                That said, spend £6 (3 x £2) and get a copy of each of your credit reports (online versions) as per this post here --> CRA's - Get your £2 Statutory Report

                                That way you'll be able to complain online which is a lot easier, in the weeks to follow.
