I have received a letter from Ist Credit dated 9/1/14 responding to the "prove it" letter that I sent dated 28/12/13.

The letter stated that they have put my A/C on hold while they request further documents from the original creditor in relation to the liability as per my request.

It looks like we have stop them in there tracks great work guys.

Do you think this will be the end of it? as I am sure it must be very close on 6 year since I made any payment on what i presume is a credit card debt.

No it won't be the end but I'll sort it if they get heavy, we'll worry about that later.

            Well done

                      Re: bankruptcy proceeding being considered

I received a letter back in Dec 13 from 1st Credit threatening bankruptcy proceeding for a lloyds bank debt of £7000 over 7yrs old (see previous treads) I send them a letter dated 28/12/13 referring to CPUTR 2008.. I received an acknowledgment letter on 9/1/14 saying that they have requested further documents from the original credit and the account is now on hold ( I have a copy of this letter).

I have now received a letter dated 27/10/14 headed bankruptcy proceeding being considers pretty much on similar lines as the first letter in Dec 13.

Shall I now send a letter headed formal complaint and attached the letter dated 28/12/13 referring to CPUTR 2008.that I sent and their acknowledgment letter dated 9/1/14?

It would appear that you have risen to the top of their list again. Probably the new boy is weeding out the old correspondence.

If you have sent the Prove It letter and they have not responded, then write referring to their letter.

As the debt is now passed the 7 year mark it will be Statute Barred if for a credit card. However as you do not KNOW what it is for, admit nothing, stick to prove it, because if it is for a mortgage or against a CCJ you will have to wait 12 years or forever. Never disclose more than you need to.

Hopefully it will be SB and you can then tell them to stop harassing you.

They must prove you owe it.

Don't do anything till you hear back from Niddy once you've answered his question in previous post.

You've sent a CPUTR letter which they are not obliged to answer so you can't really complain that they haven't. This prompted them to search for documents from the OC which have yet to materialize. I don't know how your CPUTR letter was worded but it may/may not have suggested that you recognized the account.

You've also sent a 'prove it' letter and they have yet to prove it.

You can send the SB letter once you are certain it is SB. At that point you will no longer be asking them to 'prove it' because you'll be admitting you know what it is otherwise you wouldn't be claiming it's SB (obviously).

You've not sent a CCA request so you've still got that up your sleeve.

Wait for Niddy to tell you what to do or what not to do next. Is there a deadline to respond in that latest letter?

It's a slow process but it works. In fact the slower the better when you're talking SB
