    Re: A DCA Writes

Sorry but some of what you said is rollox.

Labour in 97 took over an ecomony that had money in the pot, what they did was spend it.

Yes the cons had their issues to, like in the 90's, mortgages trippled over night, but somehow things werent as bad, people managed, today everything is effected.

And dont forget, just how many public sector jobs labour created during its 15 year rein, public sector jobs paid by tax payers, at least private sector is funded by company money.

And if we want to talk about how great Gordon Brown was, lets not forget he sold our gold at an all time low, and lost us quite a lot of money.

Im not saying Cons are any better, but its funny, how they always seem to leave office with a country in a better position than it was in previously under labour.

People managed until auntie Thatcher lifted Rental limits on rents, then they went sky high!

          On topic now

Is AAD looking at getting a CCL??

If so could there be a small branch off for collecting DCA and banking debts like the 50k in costs etc??

Yes but not for that reason. To protect us and our mods. That's all.

However we're not doing it until we officially sign this forum over to the parent limited company. So in the new year.

The question:- What can a DCA say in their letters to persuade persons who want to pay to communicate with them? By communicate we do not simply mean telephone, though that is an option, but to write/e.mail etc
The first letter needs to be nice and simple explaining that they have taken on the collection process, no need for any threats of visits or litigation. Explain that dialogue is required to bring the matter to a mutually satisfactory conclusion for both parties. Give a 'reasonable' timescale for a response from the debtor.

If a response is forthcoming deal with it on a personal basis, template letters just annoy people because they are not treat as an individual with individual circumstances, added to the fact the templates hardly ever refer to anything a debtor writes (the Nat West template replies to a lot of people on here are a prime example)

If the debtor has not responded within the allocated timescale then a slightly 'heavier' letter outlining possible legal courses of action, but still in a friendlier tone.

Still no response ? then make damn sure they do have a legal right to pursue for the money, get all info and correspondence from the original creditor, then follow the due process and specifically ensure they are trying to contact the right person at the right address (see my latest diary entry!). Also offer a good discount prior to any possible litigation.

If they do not have a legal right to the money and still no reply then offer a very good discount (80%+) to try and get a goodwill final payment of the original balance, not one with a boatload of charges stuck on it, if that fails stop wasting their and our time and write the bloody thing off so they can concentrate on the people who can or have to pay. Blasting out court letters and threats just drives people to places like this and makes people want to fight their corner in any way possible, even more so if they find out that it is unenforceable.

                Re: A DCA Writes

Although it pains me to say this, Cabot seem to have improved their introductory letters. A friend of mine has recently received one that states very clearly that they have bought her debt from the original creditor and very nicely point out that all she needs to do is forward their letter on to her DMP person who can make the necessary changes to where her payments should go now etc, etc. She even received a Goodbye letter from the original creditor!!

It's all been so polite and civilised, I had to go for a lie down!

Unfortunately for them however, her "DMP" person is me..... and now that the debt's been sold, we can challenge it.

                Remember the mantra:
                NEVER communicate by 'phone.

                Send EVERYTHING by Recorded/Special Delivery
Keep a copy of EVERYTHING sent
                Keep hold of EVERYTHING received

                  Re: A DCA Writes

I think if they were more open to email communication or some sort of web portal. A company I used to work for offered a service where by you could inform about wrong doings etc anonymously via a website. It was secure, recorded and managed by a third party so it meant neither company nor employee could change anything after it was written. It could speed up the process no end and you can have a 'conversation' with a DCA without having to speak to them.

The vast majority of people have web access at home or if not in a local library or Citizens Advice Bureau.

I'd like to see a letter that read,

                    "Dear FUWTH,

We have recently purchased your debt of £2500 for £250 so if you can pay us £500 to in a F&F, you'll make a saving, we'll make a profit and we'll both be happy.

                    Kindest Regards

                    If Carling Made DCA's

if they did that i'd say i'd pay them £300 in F&F

Still in profit both of us then really

What, how much they paid for a debt ? Not sure, I just worked on 10% but it's probably less than that. Nice job if you can get it as the saying goes.

If a DCA wrote: "We only paid 5% of the face value of your account and would be willing to settle for 7.5% paid over a reasonable period of time" - then they would be talking.

Nope. FOI is only for government departments/quango's and anyway its exempt from DPA classification based on the sensitive nature - bit like asking tesco to list it's suppliers in a SAR
