    Agree with Nightwatch.

    You have the evidence it was defaulted so they cant again. ICO is quite clear on that.

    And an AP should never leave you worse off than someone who had just defaulted and done a runner. Again ICO clear on that too.

    Sounds more like an effort to keep your account live longer.

    I had this and now have it rectified by complaining to the ICO. The DCA in my case is £50 lighter in its wallet for the hassle of pointing out the ICO guidelines to it.

    Also as Nightwatch says legal advice may be useful. Can see this becoming a battleground in the future.

    Yes report our accounts as it happens for sure. But when they get it wrong they should be more willing to alter stuff to show what happened not what they think happened.

    In your case you have evidence of a default 6 years age being reported. That should be it and if they dont remove it all now I think the ICO should grow some and fine them.

    That would soon stop the AP game they seem to be latching onto.

      But I AM in an arrangement to pay them. That's the issue. I THOUGHT that the data would drop off my CRFs regardless of an arrangement to pay? ie the Default was there for 6 years during which I have been paying them by arrangement and then, when it drops off, thats the reporting done and dusted irrespective of an arrangement? Is that incorrect?? Confused here!

      The way I read your post is that the bank are entitled to default me twice if I stop paying them now because I've been in an arrangement weith them since 2006?

        Once the default (the original and now expired one) has reached 6 years no matter what you then do with the creditor, no more data can be applied to the CRA's as the account has already been defaulted - it is NOT a new account, agreement or anything!

        Complain to ICO here --> Complain about how your information was handled - ICO

              Update.

              Captains Log Star Date 20fucking13

              Grrrr.... after my round of complaints to Experian last year I got an email in August from them stating that my complaint had been upheld and that they would supress all future reference to the Barclays account from my CRFs. The bank admitting the data was being loaded in error.

              The bank itself in my compalint to THEM admitted their systems just load the account because its bstill on an Arrangement and there is seemingly nothing they can do to stop it getting filed with the CRAs

              Equifax however don't have the same problem as Experian in suppressing this erroneous data....

              ...I checked recently and in February of this year Experian started reporting the Barclays account all over again. It HAD vanished between August 2012 and January 2013 but is now back on.

              I sent repeated emails to Experian, all ignored. Even to the customer elations officer who dealt with it last time. So I sent an email to LEE HANCOCK (who never responds) but suddenly I get a non-automated response from the same dude that handled my complaint last year.

              He is looking into it and treating it as a fresh complaint.

              So I'm forfced to fight this all over again. We all know what's coming: "we are not the data owner...take it up with Barclays."

              But I do have Experian's email upholding my complaint from last year.

                    Um, im actually taking the opposite approach Blodwin on this one.

                    I have the CRA reports on me printed out after the defaults were registered and not going anywhere near them until its a) all cleared up, or b) i need to access credit again and want to check nothing may be spoiling the 3 year search most lenders look for.
                    The reason i am doing this is many members of AAD have reported an increase in DCA activity once you sign up.

                    Is this still the general consensus?

                            Sorry Blod - what i was referring to here was the three year search lenders look for when someone applies for credit.
