        Just sue them; they'll probably not bother to defend the action and, should you win and they refuse to pay up, enforce the judgement by seeking the imprisonment of "Sir" John Collins (link ) under section 5 of the Debtors Act 1869 - link.

        Even the threat of the Chief Shit being gaoled should ensure press coverage.

          Thank you for the additional info, Phil. I'll give lovely James (I reserve the right to change my mind on this; I am, after all, a woman) a chance to respond and then follow up accordingly with any of their other employees as may be necessary.

          Obviously I'd rather not go to court; but I will if they really cannot see sense.

                Good morning all

                Bearing in mind that Niddy is taking an untimely holiday (cheek of it!) and I greatly respect his opinion, I thought I would pose the following question today so that I have some feedback on my next course of action, hopefully to include comments from Niddy and CC amongst others.

                Assuming that I do not received a timely response from "James", and considering that I am prepared to take legal action, should I :

                a) obtain a paid for engineers report for cost of repair and use this report as the basis for any legal claim;

                b) claim for the cost of the TV in full;

                c) claim a % cost of the TV based on nearly 2 years use;

                d) follow another course of action - suggestions please.


                Thank you in advance for any input - it is greatly appreciated.

                  1. Give James time to reply; 3 days (working) is suffice;
                  2. Then report it to Trading Standards - a full report/complaint
                  3. Report it to their chief executive ( john.browett@dixons.co.uk )
                  4. If no joy to the above; then consider small claims for the replacement cost of TV plus court claim. No need for an engineers report unless they try and defend things.

                  That is what I would do.

                    John Browett is the Group Chief Exec - ie he heads up Shop Direct group, regardless of the Dixons email account

                        As I say, that is what I would do, pointless wasting £150 on an engineers report when you can get a new tv for £400 - in case it backfires, which would be a travesty being the TV was not fit for purpose from the start really..... however the right threats to the right people will fix this, court won't (unless you are prepared to spend a lot of money)!

                          I'd suggest the same as Niddy has done, except that I'd say it is relatively unlikely they would even bother to defend the case as that could cost them more than the wholesale price of a new TV.

                              Quite, I would also expect them to accept the claim and pay out, BUT you know yourself mate, some of these larger companies prefer to waste £20k on something that should cost £2k and court is no different, they defend a lot just cos they can and they THINK we cannot afford to fight them.....

                                How could such a claim be successfully defended?

                                Another way to proceed would be to pay for someone to fix the set - having chosen the lowest of three quotes, to minimise one's losses - and sue the Poxmania spivs for the cost of that repair.
