Re: Niddy vs Opus (ex CitiCard)
No problem... is from 2001 so more than likely something wrong. Will get CCA sent off as they have been less than helpful and start a new thread when arrives.

Re: Niddy vs Opus (ex CitiCard)
Start a new thread mate - yes, it would apply the same as these were fixed sum running agreements kinda like a regulated overdraft which falls between s.77 & s.78 - so really hard to distinguish.Originally posted by oscar View PostApologies for jumping on thread, but I wanted to ask about something said above re fixed and running credit and the unilateral change to the agreement. Would this apply to the old Cahoot flexi loan (a running agreement) which has been changed to repayment only?
However i'd not look into the point you mention too much; i'd presume being the type of agreement that it is, there will be fault with it and also it may be incorrectly regulated - some of the old barclays reserve style things are!

Re: Niddy vs Opus (ex CitiCard)
HiOriginally posted by CleverClogs View PostHave you sent them a request for the agreement (under either s 77 or s78) with also a request for any/all other relevant documents and a statement of account?
Another point that may be worth considering is whether, by purporting to have made the account "repayment only", those numpties have varied a running credit account into a fixed credit or loan account to which more stringent requirements exist with regard to statements of account, etc..
Nope, never done a CCA Request as I have the original agreement

However in that it does say APR 15.9 and their statement that they sent me shows 17.9% so I've also got em with that - you know what, i'm just not gonna pay em - sod it. Let them default me, am I bothered?
I am too bust fighting for other people to worry about a grand on one card! Plus i'm playing silly beggars with HSBC (seen that thread yet)?
Thanks though, you've given me food for thought

So in essence they cannot enforce this in court, assuming I cease repayments (which evidently I have as i'm 4 payments late on a £0 balance/£1k balance) lol
I dunno myself cos i've not had a statement since last October

So they are not exempt from the legal obligation to issue statements of account, under either section 77 or section 78 of the Consumer Credit Act 1974.Originally posted by Never-In-Doubt View PostNooo, it has £1k on the card or summat like that.... that sometimes comes and goes mind!

How much do those scrapie-infested mutton-heads allege you owe?Originally posted by Never-In-Doubt View PostI've just had an Equifax alert!!
Seems opus have now marked me 4 (yes four) months in arrears!!!
In post #15 - link - the report shews a credit limit of £2000, yet a statement balance of £0.
How is it possible to owe nothing and yet still be in arrears?

Perhaps they are not complete morons, in that they have much of their cerebral cortex missing?Originally posted by swanfan View PostWell what a complete & utter screw up by Opus.
And i thought i'd dealt with some total morons in the banking industry, are they really so thick?
One might have hoped, however, that the complaint would have been passed along to be handled by someone less evidently lissencephalic.

Again making the same derisory offer of £25 compensation, which would be inadequate even if they were the Bank of Toyland.Originally posted by Never-In-Doubt View Post[FONT=Verdana][SIZE=2]12.05.2011 - Opus reply to my letter of 06.05.2011
