1st credit bought a MBNA loan over 2 years ago...today out of the blue comes NOTICE OF INTENDED ACTION...from mackenzie hall. I've heard nothing in over 18 months.. no statement nothing :hmm

Interesting question for this thread. When does an "application form" become a fully compliant agreement under CCA1974 pre 2006 amendments and the repeal of s127?

Even though no copy of said application forms as agreements have been issued to the consumer party.

Just a quick thought....I still get credit card statement for RBS .
Balance £12,744
This months minimum payment £9,153.25
This account is unenforceable.....I have a letter from Nov 2009 telling me this.
Wonder what will happen when the min payment gets to the balance & when they will stop sending statement.

If they stop sending statement then they'll be in breach of guidelines so will [B]always [/B]send at least one a year mate :beer

I have one of these...CCA'd them, got the (framed) letter saying they don't have an agreement and since then they send the statement every month, no interest added, min payment has been full balance for ages.

can a creditor take court action such as sending SD or applying for a charge on your home if you have sent them CCA requests ?

Not if they're in default of your request, no. However those that try it soon get swatted away when we get Paul on the case. :beer
