Re: Unenforceability General Questions & Answers

Just a quick question. If the debt was in my maiden name must request the CCA in that name or in my new name along with a copy of my marriage certificate? Thanks in advance

Good question! Was the dmp in your married name? If it was, I'd sign it using your married name.

I have debts in my maiden name; I just use that when I correspond with them.

            Thanks for that Jane.

I haven't used my maiden name since the 70s :eek

I'd ask in your married name because your maiden name must be on any recon so they might struggle to get it (or they might not).

Re: Unenforceability General Questions & Answers

I signed the debt management in maiden name, requested it changed loads of times but they failed to do it. So it's best to do it in married name? Should I send marriage certificate with it or is that something they van verify it via equifax and experian?

No need for your marriage certificate.

                      Hi Sammieejai..... :)

When you're ready, send a separate CCA request to each company currently collecting payments from you.... using the name that they have on file for you..... and make sure each request goes off by rec. delivery with a Postal Order for the £1 fee (not a cheque). Initial each request; don't use a normal signature.

Make sure that you can correspond each of your rec. delivery receipts to the relevant CCA request and get a set of cheap files from Tesco or somewhere so that you can file every bit of correspondence to the correct CCA request. That way you won't get confused.

                      Let's see what they've got.... :)

Re: Unenforceability General Questions & Answers

Thankyou Priorityone. After reading through some other posts I would like to manage my own payments to everyone and ditch payplan. I know I cannot go for unenforceability with all apart from 2 as the others are old mobile phone contracts, bills and a payday loan, do I send a cca request to all of them too? Is there a way I can ask/try to reduce the debt with letters and make ny own plan?

Start a thread of your own (if you haven't already) and we can then work through the best way forward on each one. The thing to remember is to put yourself in control at all times.... so if repayments on a mobile phone debt are currently too high, we can look at getting them reduced right down to an affordable level.

                          :)

                            Evening to all,

Can someone give a silly old bloke some advice please.
Started my UE Diary a few months ago but like everything takes time and effort to get all info together and I am a slacker. Well I only managed to get one account in at the start of my Diary, can I just simply add more accounts at any time or should they only be at the begining my Diary is on post 40 something now but just 1 account.

Whilst I am asking questions, If you are stayed in court and its been 2and half years since last payment is SB clock running? or is it exempt due to court proceedings:(

                            Spent

Thanks Niddy, thought that might be the best way to go. 1st post might end up a bit on the large side in time:D:D

That's good news my thread hiding in legal section has been stayed for over 2 years now, perhaps this is tempting fate (let sleeping dogs and all that).

Something else if you are still around Niddy Your thread:

I can't see the images of Example Agreements the little images don't open for me, am I missing something on my computer or is it a bug that needs to be sorted after the site update.

                                Cheers Spent
