Re: Mercantile Credit v Huxtable; Mercantile Credit v Ellis 1987

This is the quote of the whole judgment to me - basically, "sorry mate, you're fooked"

The appeal in fact is a multiple appeal in relation to a number of respondents against whom charging orders were made, and in respect of whose charging orders nisi the Deputy Registrar dismissed the company's application. I need therefore only deal with one of the appeals. The issues that arise in each appeal are precisely equivalent, and they raise questions of very considerable importance to the appellants, upon whom the incidence of the law in this respect may seem to lean adversely.

Thank you so much Shep. I hope I never need it if you follow me. Was this judgement in the Court of Appeal so can't be ignored by a DJ in a lower court?

Thanks Shep, I have been looking for this for ages. The motto for everyone is that if you get a CCJ make sure that you get an instalment order and keep to your payments.
