  • Mortgage arrears question

    We keep getting a letter saying we are in arrears - this has only started happening the past few months - my husband phoned the mortgage provider and was told this information .

    they said it is because when the mortgages first started they allowed the first payment to be a month later, they did it to everyone to make things easier for the customers but this technically put everyone a month in arrears , we have never been charged for it and it never shows as bad credit but it is owed and they want the payment, it can be paid little by little or technically when the mortgage ends it will have one more payment left.

    I'm confused as to why this has been brought up now after 11 years of having a mortgage with this company .

      Is this do to with the same problem you had with your lender (Kensington mortgages?) in April 2015 where they said you were in arrears because they needed you to pay a month in advance not a month in arrears?

        Hi-No we cleared the arrears and they said this is happening with all their customers . We never pay late now and always pay a little extra each month just to round the figure off .

          We are thinking of sending a SAR into Kensington because we know we never had arrears from the beginning of the mortgage, we just think it is dodgy that when we were in arrears afew years back they never noticed these mysterious other arrears from the start of our mortgage , also when my husband phoned about these new arrears he was told that we could leave them as they are and would pay back when the mortgage comes to an end. We only have an interest only mortgage and we round off the amount each month which could be a few pounds, Kensington have been taking the few pounds off the arrears they say we owe.
          We are also questioning them about the 11% interest rise within 9 months , my husband has written to them and asked for the detailed explanation of when the interest rate went up .
          Can we send a SAR to our mortgage company or is that just for credit cards loans and such ?

          PS not been in arrears since 2014 but now this cropped up out of the blue and all our debts are statute barred now so this will have an affect on our credit rating which we would really like to build up again .

            Yes, you can send a SAR to Kensington Mortgages

            It's been free since 25th May and they should comply within 30 days.

              Thank you I will get one sent off , just received copies of the letters they sent us about the interest rate going up 11% in 10 months , that's a waste of time as we have those letters .

                I am very disappointed that Prime Minister Teresa May condones the unfair treatment inflicted on so many by Kensington Mortgage Company, owned by Northview Group by opening their head office in 2016, after they had been fined for treating borrowers in financial difficulty so unfairly: https://www.businessmag.co.uk/maiden...-headquarters/

                  Ours has gone up again and reckon there will be more rises . Can't wait to sell up and buy cash to be rid of a mortgage .

                    Adding to this thread as it is more of the same problem, I do hope someone can advise me as getting our debt problems in hand now that I have been awarded PIP hubby waiting for carers ,and he's going to give up wtc and go onto UC where we can claim SMI .
                    So here are my questions if anyone can help please ?

                    Kensington sold our account to Mars Capital in Feb this year , so will be offering a repayment to them as fallen into arrears of over £5,000 due to me having cancer .
                    Anyway Kensington over the years added £595 in fees even when we had a repayment agreement in place for arrears .
                    Can we claim these fees back even though they have sold our account on to Mars who are also adding fees now which is adding to the arrears . ?
                    Thanks if anyone knows .

                    Also if we apply for SMI can the arrears be included in the claim to help us at least pay back and get back on track ?
