    HI Nanna,

I hope you are keeping well.

it is 10 steps forward and then 10 steps back, on the level of stress.

Although I knew deep down the outcome would not differ from what the adjudicator's decision was, seeing it in black & white has really stressed me outt. What I find so hard to believe, is that LS have advised they waived one of the loans as a goodwill gesture, yet they sent an email to me advising it did not meet their criteria! I supplied the email as evidence to the FOS.

If I was not at home with my parents , I would not be as stressed. I am just really concerned that LS get really heavy with me and send DCA around to my home or start calling me at work.

    Fondest wishes
    Natty

Thanks SnV, For getting back to me so quickly.

Deep down I was expecting this result, as you & the kind peeps on this forum have advised me what cowards the FOS are.

I will try and chill and not stress too much, which will be hard.

Have a good weekend and many thanks once again.

    Natty

I have not slept well at all last night, just stressing so much. I am thinking that maybe I should go with option 3. I know I have got until the 30 October.

    Hi Natty

So while this isn't what you hoped for its not unexpected. Remember the FOS cannot make comment on legislative points, and only the courts can decide as to whether the loans made to you are enforceable or not. What you have to remember is that NONE of the legal issues in your complaint have been dealt with by LS, and so they can still be challenged on those points.

You've now got until the 30th October to make a decision to accept or reject the FOS offer, so don't worry about things until about the 29th!

If LS start chasing you for payment before then, tell them to F.O. as you will still be considering the FOS offer.

But ultimately you have 3 choices now:

    1) Reject the FOS offer and tell LS to F.O. and not pay them. They will squeal and gnash their teeth but you will deal with that. There is a miniscule possibility they could issue a court claim, but there a LOT of issues they have to address, and should a judgement go against them, they way they have been issuing multiple loans would potentially destroy their business overnight.

    2) Accept the FOS offer

    3) Accept the FOS offer, but on revised payment plan based on updated I/E info

But theres no rush so take a deep breath and forget about them for the weekend.

I have received a response from the FOS with the final decision. There is no surprises, they basically do not think LS have done anything wrong. They advise the following:

1.) LS to write off all interest & charges from January 2015.

2.) Enter into a re-payment plan of £110.00 per month

The said that LS wrote off one of the loans as a gesture g goodwill.

They have given me until the 30 October to accept or reject the offer.

I was really hoping the FOS would side with me. As soon as I read the letter I was stressed. £110.00 is a lot of money. I think I offered this initally across all the loans as I was so stressed.

I am really worried as I am expecting LS to now start chasing payment.

    Best regards

Ok, well I would still not worry.

FOS cant make you do anything, nor do you have to accept their decision.

As for LS - they really cant have what you haven't got.

The response from FOS - is it from the Adjudicator or an Ombudsman - if it's from the Adjudicator, you still have the right to get the decision reviewed by the latter. Decision probably wont change, but it further delays any actions that can be taken.

Its also only recommendations from FOS - you are not obliged to accept them or their decision.

Natty all the companies try to bully you with loads of contact then, when they realise that you are not nieve or an easy touch they stop. They may restart at some time, but as the situation will be the same, you just come here and another reply will be drafted for you.

Hearing nothing from P2P is a GOOD thing. If they thought you could be bullied they would be harassing you right now. As it stands they are not, so please enjoy the peace and quiet!

Silence from the Ombudsman is also good. If you want these debts to become statute barred then you have to play the waiting game - therefore inactivity by the creditor is exactly what you want.......

Thanks SnV, I understand what you are saying, it just really worries me, the no contact, but as you say it is a good thing that I have had no contact.

I hope all is well in your world.

    Hi All,

Just an update still no response.

My LS dispute is still with the Ombudsman. I know SnV said it can take several months for a response.

I have just been looking at the last email I received from P2P, It is dated the 7 May 2015. It advises they will response to my letter of complaint within 8 weeks! Well they have failed already. Not heard anything from them at all.

I hope everyone us keeping well.

    Warmes wishes to all

    Natty
